SYNOPSIS AS INTRODUCED:

210 ILCS 55/2.12 rep.

    Amends the Home Health, Home Services, and Home Nursing Agency Licensing Act. In the definitions of "home services agency" and "home nursing agency", removes language referring to such an agency that acts as a placement agency. Repeals a provision defining "placement agency".

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Home Health, Home Services, and Home Nursing
5Agency Licensing Act is amended by changing Sections 2.08 and
62.11 as follows:
 
7    (210 ILCS 55/2.08)
8    Sec. 2.08. "Home services agency" means an agency that
9provides services directly, or acts as a placement agency, for
10the purpose of placing individuals as workers providing home
11services for consumers in their personal residences. "Home
12services agency" does not include agencies licensed under the
13Nurse Agency Licensing Act, the Hospital Licensing Act, the
14Nursing Home Care Act, the ID/DD Community Care Act, the
15Specialized Mental Health Rehabilitation Act, or the Assisted
16Living and Shared Housing Act and does not include an agency
17that limits its business exclusively to providing
18housecleaning services. Programs providing services
19exclusively through the Community Care Program of the Illinois
20Department on Aging, the Department of Human Services Office of
21Rehabilitation Services, or the United States Department of
22Veterans Affairs are not considered to be a home services
23agency under this Act.

5    Sec. 2.11. "Home nursing agency" means an agency that
6provides services directly, or acts as a placement agency, in
7order to deliver skilled nursing and home health aide services
8to persons in their personal residences. A home nursing agency
9provides services that would require a licensed nurse to
10perform. Home health aide services are provided under the
11direction of a registered professional nurse or Advanced
12Practice nurse. A home nursing agency does not require
13licensure as a home health agency under this Act. "Home nursing
14agency" does not include an individually licensed nurse acting
15as a private contractor or a person that provides or procures
16temporary employment in health care facilities, as defined in
17the Nurse Agency Licensing Act.

20    Section 10. The Home Health, Home Services, and Home
21Nursing Agency Licensing Act is amended by repealing Section
222.12.
