SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.12b new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that over-the-counter medications that are prescribed to a recipient of medical assistance by a physician, a physician's assistant, a nurse practitioner, or any other medical care provider qualified to prescribe medications shall be covered under the State's medical assistance program. Provides that pharmacies providing prescribed over-the-counter medications shall be reimbursed at the same rate determined by the Department of Healthcare and Family Services for prescription medications covered under the State's medical assistance program. Requires the Department to establish guidelines and standards by administrative rule on the documentation, if any, a medical care provider must submit when prescribing an over-the-counter medication to a recipient of aid under the Code. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-5.12b as follows:
 
6    (305 ILCS 5/5-5.12b new)
7    Sec. 5-5.12b. Over-the-counter medications.
8Over-the-counter medications that are prescribed to a
9recipient of aid under this Article by a physician, a
10physician's assistant, a nurse practitioner, or any other
11medical care provider qualified to prescribe medications shall
12be covered under the State's medical assistance program under
13this Article. Pharmacies providing prescribed over-the-counter
14medications under this Article shall be reimbursed at the same
15rate determined by the Department for prescription medications
16covered under the State's medical assistance program. The
17Department shall establish guidelines and standards by
18administrative rule on the documentation, if any, a medical
19care provider must submit when prescribing an over-the-counter
20medication to a recipient of aid under this Code.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
