SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-2.04 new

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that in accordance with applicable federal law and regulations, children who apply for medical assistance shall be presumed eligible for medical services provided under the State's medical assistance program, including dental services, pending a formal eligibility determination by the Department of Healthcare and Family Services. Provides that the Department shall adopt any rules necessary to implement this provision.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 5-2.04 as follows:

(305 ILCS 5/5-2.04 new)

Sec. 5-2.04. Presumptive eligibility; children. In accordance with applicable federal law and regulations, children who apply for medical assistance pursuant to this Article shall be presumed eligible for medical services provided under the State's medical assistance program, including dental services, pending a formal eligibility determination by the Department. The Department shall adopt any rules necessary to implement this provision.
