SYNOPSIS AS INTRODUCED:

Amends the Property Tax Code. Provides that if the office of Township Assessor is discontinued in Evanston Township, then the City of Evanston shall assume the duties of the Assessor. Amends the Township Code. Provides that the voters of Evanston Township may vote to discontinue township organization. Provides that if township organization is discontinued, then the City of Evanston shall assume all powers, duties, assets, property, liabilities, obligations, and responsibilities of the township. Further provides that upon discontinuance, the office of Township Assessor and Township Supervisor shall also cease, and the City of Evanston shall assume the duties of Assessor and Supervisor. Sets forth procedures for distributing township assets, keeping of records, and the disposal of property. Amends the Public Health District Act. Provides that if the office of Township Assessor is discontinued, then the city council members of the City of Evanston shall be the board of health for the public health district. Amends the Illinois Public Aid Code. Provides that upon discontinuance of Evanston Township, the City of Evanston shall provide funds for and administer the specified public aid programs. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Property Tax Code is amended by adding Section 3-70 as follows:

Sec. 3-70. Cessation of Township Assessor. If the office of Township Assessor in Evanston Township ceases as provided in Section 25-30 of the Township Code, then the City of Evanston shall assume the duties of the Township Assessor under this Code.

Section 10. The Township Code is amended by adding Section 25-30 as follows:

Sec. 25-30. Discontinuance of Evanston Township.

(a) The board of trustees of coterminous Evanston Township may, by ordinance, submit a proposition to discontinue township organization to the electors of the township at a general election or consolidated election in accordance with general election law.

The proposition shall be in substantially the following form:

Shall the township organization be continued in Evanston Township?

The votes shall be recorded as "Yes" or "No".

If it appears by the returns of the election that a majority of the votes of the township cast on the question of the continuance of township organization at the election are against the proposed option for continuance, then township organization shall cease in the township on January 1 of the calendar year immediately following the calendar year that the proposition was approved by the electors. Upon discontinuance of township organization, all powers, duties, assets, property, liabilities, obligations, and responsibilities of the township shall be assumed by the City of Evanston.

(b) If it appears by the returns of the election that a majority of the votes of the township cast on the question of the continuance of township organization are against continuance, then the office of Township Supervisor and the office of Township Assessor shall cease in the township at the next January 1 after the proposition was approved. If the office of Township Supervisor ceases, then the City of Evanston shall assume the duties of Township Supervisor. If the office of Township Assessor ceases, then the City of Evanston shall assume the duties of the Township Assessor under the Property Tax Code and the Public Health District Act.

(c) The City of Evanston shall assume all taxing authority of the township abolished under this Section. For purposes of distribution of revenue, the City of Evanston shall assume the power, duties, and obligations of the township.

(d) Upon discontinuance of township organization, the records of the township shall be deposited in the city clerk's office. The City of Evanston may close up all unfinished business of the township and sell and dispose of any of the property belonging to the township, as fully as might have been done by the township itself, for benefit of the inhabitants of the City of Evanston.

(e) Nothing in this Section shall prevent the City of Evanston from entering into an intergovernmental agreement or contract to provide for general assistance or property assessment duties for services under its jurisdiction.

Section 15. The Public Health District Act is amended by adding Section 25 as follows:

Sec. 25. Cessation of Township Assessor. If the office of Township Assessor in Evanston Township ceases as provided in Section 25-30 of the Township Code, then the Evanston City Council members shall be the board of health for the public health district under this Act.

Section 20. The Illinois Public Aid Code is amended by adding Section 12-3.1 as follows:

Sec. 12-3.1. Discontinuance of Evanston Township. Upon discontinuance of Evanston Township, the City of Evanston shall provide funds for and administer the public aid program provided for under Article VI of this Code.

Section 99. Effective date. This Act takes effect upon becoming law.
