SYNOPSIS AS INTRODUCED:
 
35 ILCS 200/3-70 new
60 ILCS 1/25-30 new
70 ILCS 905/25 new
305 ILCS 5/12-3.1 new

    Amends the Property Tax Code. Provides that if the office of Township Assessor is discontinued in Evanston Township, then the City of Evanston shall assume the duties of the Assessor. Amends the Township Code. Provides that the voters of Evanston Township may vote to discontinue township organization. Provides that if township organization is discontinued, then the City of Evanston shall assume all powers, duties, assets, property, liabilities, obligations, and responsibilities of the township. Further provides that upon discontinuance, the office of Township Assessor and Township Supervisor shall also cease, and the City of Evanston shall assume the duties of Assessor and Supervisor. Sets forth procedures for distributing township assets, keeping of records, and the disposal of property. Amends the Public Health District Act. Provides that if the office of Township Assessor is discontinued, then the city council members of the City of Evanston shall be the board of health for the public health district. Amends the Illinois Public Aid Code. Provides that upon discontinuance of Evanston Township, the City of Evanston shall provide funds for and administer the specified public aid programs. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Property Tax Code is amended by adding
5Section 3-70 as follows:
 
6    (35 ILCS 200/3-70 new)
7    Sec. 3-70. Cessation of Township Assessor. If the office of
8Township Assessor in Evanston Township ceases as provided in
9Section 25-30 of the Township Code, then the City of Evanston
10shall assume the duties of the Township Assessor under this
11Code.
 
12    Section 10. The Township Code is amended by adding Section
1325-30 as follows:
 
14    (60 ILCS 1/25-30 new)
15    Sec. 25-30. Discontinuance of Evanston Township.
16    (a) The board of trustees of coterminous Evanston Township
17may, by ordinance, submit a proposition to discontinue township
18organization to the electors of the township at a general
19election or consolidated election in accordance with general
20election law.
21    The proposition shall be in substantially the following

2        Shall the township organization be continued in
3    Evanston Township?
4    The votes shall be recorded as "Yes" or "No".
5    If it appears by the returns of the election that a
6majority of the votes of the township cast on the question of
7the continuance of township organization at the election are
8against the proposed option for continuance, then township
9organization shall cease in the township on January 1 of the
10calendar year immediately following the calendar year that the
11proposition was approved by the electors. Upon discontinuance
12of township organization, all powers, duties, assets,
13property, liabilities, obligations, and responsibilities of
14the township shall be assumed by the City of Evanston.
15    (b) If it appears by the returns of the election that a
16majority of the votes of the township cast on the question of
17the continuance of township organization are against
18continuance, then the office of Township Supervisor and the
19office of Township Assessor shall cease in the township at the
20next January 1 after the proposition was approved. If the
21office of Township Supervisor ceases, then the City of Evanston
22shall assume the duties of Township Supervisor. If the office
23of Township Assessor ceases, then the City of Evanston shall
24assume the duties of the Township Assessor under the Property
25Tax Code and the Public Health District Act.
26    (c) The City of Evanston shall assume all taxing authority

1of the township abolished under this Section. For purposes of
2distribution of revenue, the City of Evanston shall assume the
3power, duties, and obligations of the township.
4    (d) Upon discontinuance of township organization, the
5records of the township shall be deposited in the city clerk's
6office. The City of Evanston may close up all unfinished
7business of the township and sell and dispose of any of the
8property belonging to the township, as fully as might have been
9done by the township itself, for benefit of the inhabitants of
10the City of Evanston.
11    (e) Nothing in this Section shall prevent the City of
12Evanston from entering into an intergovernmental agreement or
13contract to provide for general assistance or property
14assessment duties for services under its jurisdiction.
 
15    Section 15. The Public Health District Act is amended by
16adding Section 25 as follows:

18    Sec. 25. Cessation of Township Assessor. If the office of
19Township Assessor in Evanston Township ceases as provided in
20Section 25-30 of the Township Code, then the Evanston City
21Council members shall be the board of health for the public
22health district under this Act.
 
23    Section 20. The Illinois Public Aid Code is amended by

1adding Section 12-3.1 as follows:
 
2    (305 ILCS 5/12-3.1 new)
3    Sec. 12-3.1. Discontinuance of Evanston Township. Upon
4discontinuance of Evanston Township, the City of Evanston shall
5provide funds for and administer the public aid program
6provided for under Article VI of this Code.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
