1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
53A-4 as follows:
 
6    (105 ILCS 5/3A-4)  (from Ch. 122, par. 3A-4)
7    Sec. 3A-4. Mandatory consolidation of educational service
8regions.
9    (a) After July 1, 2015 October 15, 1993, each region must
10contain at least 61,000 43,000 inhabitants. Before June 30,
112013, regions Regions may be consolidated voluntarily under
12Section 3A-3 or by joint resolution of the county boards of
13regions seeking to join a voluntary consolidation, effective
14July 1, 2015, to meet these population requirements. The
15boundaries of regions already meeting these population
16requirements on the effective date of this amendatory Act of
17the 97th General Assembly 1993 may not be changed except to
18consolidate with another region or a whole county portion of
19another region which does not meet these population
20requirements. If, before January 1, 2014, locally determined
21consolidation decisions result in more than 35 45 regions of
22population greater than 61,000 43,000 each, the State Board of
23Education shall, before June 1, 2014, direct further

1consolidation, beginning with the region of lowest population,
2until the number of 35 45 regions is achieved.
3    (b) (Blank).
4    (c) If, within 90 days after the most recent certified
5federal census, a region does not meet the population
6requirements of this Section, then regions may be consolidated
7voluntarily under Section 3A-3 of this Code or by joint
8resolution of the county boards of regions seeking to join a
9voluntary consolidation to meet these population requirements.
10If locally determined consolidation decisions result in a
11region not meeting the population requirements of this Section
12or result in more than 35 regions, then the State Board of
13Education shall have the authority to impose further
14consolidation by order of the State Superintendent of
15Education. Such an order shall be a final order and is subject
16to the Administrative Review Law. If any region does not meet
17the population requirements of this Section the State Board of
18Education, within 15 days after the above said dates, shall
19direct such consolidation of that region with another region or
20regions to which it is contiguous as will result in a region
21conforming to these population requirements.
22    (d) All population determinations shall be based on the
23most recent federal census.

25    Section 99. Effective date. This Act takes effect upon
26becoming law.
