SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-4.1a new

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that, a recipient of aid under the State's medical assistance program shall be entitled to coverage for only one emergency room visit per year for a non-emergency situation. Provides that the Department shall not be responsible for providing Medicaid reimbursement for a recipient's non-emergency visits to an emergency room that exceed this one visit per year limitation.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 5-4.1a as follows:

(305 ILCS 5/5-4.1a new)

Sec. 5-4.1a. Emergency room use for non-emergency situations. Beginning on the effective date of this amendatory Act of the 97th General Assembly, a recipient of aid under this Article shall be entitled to coverage for only one emergency room visit per year for a non-emergency situation. The Department shall not be responsible for providing Medicaid reimbursement for a recipient's non-emergency visits to an emergency room that exceed this one visit per year limitation.
