SYNOPSIS AS INTRODUCED:

Amends the Medical Assistance Article of the Illinois Public Aid Code and the Early Intervention Services System Act. Requires the Department of Healthcare and Family Services and the Department of Human Services, as the lead agency responsible for administering the early intervention program, to adopt rules to include applied behavior analysis services provided by Board-certified behavior analysts as a covered service, subject to appropriations, to individuals eligible for medical assistance or early intervention services; and to adopt rules for a behavior analyst certified by the Behavior Analyst Certification Board to participate in the medical assistance program and the early intervention program, subject to appropriations. Effective immediately.

AN ACT concerning public aid.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 5-31 as follows:

(305 ILCS 5/5-31 new)

Sec. 5-31. Applied behavior analysis services.

(a) The Department of Healthcare and Family Services shall adopt rules to include applied behavior analysis services provided by Board-certified behavior analysts as a covered service, subject to appropriations, to individuals eligible for medical assistance under this Article.

(b) The Department of Healthcare and Family Services shall adopt rules for a behavior analyst certified by the Behavior Analyst Certification Board to participate in the medical assistance program, subject to appropriations.

Section 10. The Early Intervention Services System Act is amended by adding Section 12.5 as follows:

(325 ILCS 20/12.5 new)

Sec. 12.5. Applied behavior analysis services.

(a) The lead agency shall adopt rules to include applied behavior analysis services provided by Board-certified behavior analysts as a covered service, subject to appropriations, to individuals eligible for early intervention services under this Act.

(b) The lead agency shall adopt rules for a behavior analyst certified by the Behavior Analyst Certification Board to participate in the early intervention program, subject to appropriations.

Section 99. Effective date. This Act takes effect upon becoming law.
