SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/8.25c  from Ch. 127, par. 144.25c

    Amends the State Finance Act. Provides that, continuing through the fourth quarter of fiscal year 2012 (rather than, until the sum of $31,200,000 is paid to the General Revenue Fund), the State Comptroller shall order transferred and the State Treasurer shall transfer from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the General Revenue Fund 35% of revenue deposited into the Adeline Geo-Karis Illinois Beach Marina Fund in any fiscal year. Provides that, continuing through the fourth quarter of fiscal year 2012 (rather than, until the sum of $8,000,000 is paid to the State Boating Act Fund), the State Comptroller shall order transferred and the State Treasurer shall transfer from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the State Boating Act Fund 15% of the revenue deposited into the Adeline Jay Geo-Karis Illinois Beach Marina Fund. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by changing
5Section 8.25c as follows:
 
6    (30 ILCS 105/8.25c)  (from Ch. 127, par. 144.25c)
7    Sec. 8.25c. (a) Beginning in fiscal year 1991 and
8continuing through the third quarter of fiscal year 1993, the
9State Comptroller shall order transferred and the State
10Treasurer shall transfer from the Illinois Beach Marina Fund
11(now known as the Adeline Jay Geo-Karis Illinois Beach Marina
12Fund) to the General Revenue Fund 50% of the revenue deposited
13into the Illinois Beach Marina Fund. Beginning in the fourth
14quarter of fiscal year 1993 and continuing through the fourth
15quarter of fiscal year 2012 thereafter until the sum of
16$31,200,000 is paid to the General Revenue Fund, the State
17Comptroller shall order transferred and the State Treasurer
18shall transfer from the Adeline Jay Geo-Karis Illinois Beach
19Marina Fund (formerly known as the Illinois Beach Marina Fund)
20to the General Revenue Fund 35% of revenue deposited into the
21Adeline Jay Geo-Karis Illinois Beach Marina Fund (formerly
22known as the Illinois Beach Marina Fund) in any fiscal year. In
23addition, beginning in fiscal year 1991 and continuing through

1the fourth quarter of fiscal year 2012, thereafter until the
2sum of $8,000,000 is paid to the State Boating Act Fund the
3State Comptroller shall order transferred and the State
4Treasurer shall transfer from the Adeline Jay Geo-Karis
5Illinois Beach Marina Fund (formerly known as the Illinois
6Beach Marina Fund) to the State Boating Act Fund 15% of the
7revenue deposited into the Adeline Jay Geo-Karis Illinois Beach
8Marina Fund (formerly known as the Illinois Beach Marina Fund).
9Beginning in fiscal year 1992, the transfers from the Adeline
10Jay Geo-Karis Illinois Beach Marina Fund (formerly known as the
11Illinois Beach Marina Fund) to the State Boating Act Fund shall
12be made only at the direction of and in the amount authorized
13by the Department of Natural Resources. Moneys transferred
14under authorization of this Section to the State Boating Act
15Fund in fiscal year 1992 before the effective date of this
16amendatory Act of 1991 may be transferred to the Illinois Beach
17Marina Fund (now known as the Adeline Jay Geo-Karis Illinois
18Beach Marina Fund) at the direction of the Department of
19Natural Resources. The transfers required under this Section
20shall be made within 30 days after the end of each quarter
21based on the State Comptroller's record of receipts for the
22quarter. The initial transfers shall be made within 30 days
23after June 30, 1990 based on revenues received in the preceding
24quarter. Additional transfers in excess of the limits
25established under this Section may be authorized by the
26Department of Natural Resources for accelerated payback of the

1amount due.
2    (b) The Department may, subject to appropriations by the
3General Assembly, use moneys in the Adeline Jay Geo-Karis
4Illinois Beach Marina Fund (formerly known as the Illinois
5Beach Marina Fund) to pay for operation, maintenance, repairs,
6or improvements to the marina project; provided, however, that
7payment of the amounts due under the terms of subsection (a)
8shall have priority on all moneys deposited in this Fund.
9    (c) Moneys on deposit in excess of that needed for payments
10to the General Revenue Fund and the State Boating Act Fund and
11in excess of those moneys needed for the operation,
12maintenance, repairs, or improvements to the Adeline Jay
13Geo-Karis Illinois Beach Marina as determined by the Department
14of Natural Resources may be transferred at the discretion of
15the Department to the State Parks Fund.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
