1    AN ACT concerning service dogs.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-6.02 as follows:
 
6    (105 ILCS 5/14-6.02)  (from Ch. 122, par. 14-6.02)
7    Sec. 14-6.02. Service animals. Service animals such as
8guide dogs, signal dogs or any other animal individually
9trained to perform tasks for the benefit of a student with a
10disability shall be permitted to accompany that student at all
11school functions, whether in or outside the classroom. For the
12purposes of this Section, "service animal" has the same meaning
13as in Section 1 of the Service Animal Access Act.

15    Section 10. The Guide Dog Access Act is amended by changing
16the title of the Act and Sections 0.01 and 1 as follows:

1    Sec. 0.01. Short title. This Act may be cited as the
2Service Animal Guide Dog Access Act.

5    Sec. 1. When a blind, hearing impaired or physically
6handicapped person with a physical, mental, or intellectual
7disability requiring the use of a service animal or a person
8who is subject to epilepsy or other seizure disorders is
9accompanied by a service animal a dog which serves as a guide,
10leader, seizure-alert, or seizure-response dog for such person
11or when a trainer of a service animal guide, leader,
12seizure-alert, or seizure-response dog is accompanied by a
13service animal guide, leader, seizure-alert, or
14seizure-response dog or a dog that is being trained to be a
15guide, leader, seizure-alert, or seizure-response dog, neither
16the person nor the service animal dog shall be denied the right
17of entry and use of facilities of any public place of
18accommodation as defined in Section 5-101 of the "Illinois
19Human Rights Act", if such dog is wearing a harness and such
20person presents credentials for inspection issued by a school
21for training guide, leader, seizure-alert, or seizure-response
22dogs.
23    For the purposes of this Section, "service animal" means a
24dog or miniature horse trained or being trained as a hearing
25animal, a guide animal, an assistance animal, a seizure alert

1animal, a mobility animal, a psychiatric service animal, an
2autism service animal, or an animal trained for any other
3physical, mental, or intellectual disability. "Service animal"
4includes a miniature horse that a public place of accommodation
5shall make reasonable accommodation so long as the public place
6of accommodation takes into consideration: (1) the type, size
7and weight of the miniature horse and whether the facility can
8accommodate its features; (2) whether the handler has
9sufficient control of the miniature horse; (3) whether the
10miniature horse is housebroken; and (4) whether the miniature
11horse's presence in the facility compromises legitimate safety
12requirements necessary for operation.
13    Any violation of this Act is a Class C misdemeanor.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
