1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Groundwater Protection Act is
5amended by changing Section 9.1 as follows:
 
6    (415 ILCS 55/9.1)
7    Sec. 9.1. Notification of actual or potential
8contamination.
9    (a) Whenever the Agency identifies any volatile organic
10compound in excess of the Board's Groundwater Quality Standards
11or the Safe Drinking Water Act maximum contaminant level while
12performing its obligations under Section 7 of this Act, Section
1313.1 of the Environmental Protection Act, or the federal Safe
14Drinking Water Act, the Agency shall notify the Department,
15unless notification has already been provided, and the unit of
16local government affected.
17    (b) Within 60 days after of receipt of notice provided for
18in subsection (a) of this Section, the Department, or the
19Department in coordination with the delegated county health
20department, shall provide notice to the public identifying the
21contaminants of concern. The notice shall be posted on the
22Department's Internet website and provided by means of other
23electronic or print media and must be designed to inform the

1owner of any private water system, semi-private water system,
2or non-community public water system within an area potentially
3affected by the identified contamination of the need for the
4system owner to test the system for possible contamination. The
5notice shall appear in the media for 3 consecutive weeks and
6must also appear on the Department's Internet website for not
7less than that period of time.
8    (c) A unit of local government shall take any action that
9it deems appropriate, such as informing any homeowner who
10potentially could be adversely affected, within a reasonable
11time after notification by the Agency under subsection (a) of
12this Section.
