55 ILCS 5/3-5047

    Amends the Counties Code. Provides that the county recorder shall redact all private information of law enforcement personnel from county land records and home sale records, and shall not allow access to the information by the general public. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
53-5047 as follows:
 
6    (55 ILCS 5/3-5047)
7    Sec. 3-5047. Removal of personal information. Upon request
8by any person, the recorder shall redact or remove that
9person's social security number, employer taxpayer
10identification number, driver's license number, State
11identification number, passport number, checking account
12number, savings account number, credit card number, debit card
13number, or personal identification (PIN) code from any internet
14website maintained by the recorder or used by the recorder to
15display public records. The request must be made in writing and
16delivered by mail, facsimile, electronic transmission, or in
17person to the office of the recorder. The request must specify
18the personal information to be redacted and identify the
19document that contains the personal information.
20    Within 12 months after the effective date of this
21amendatory Act of the 95th General Assembly all county
22recorders that publicly display records on an Internet website
23must submit a written policy, including a timeline, to their

1respective county boards providing for the redaction of social
2security numbers from all records publicly displayed on the
3website. Any county recorder that launches a website on or
4after the effective date of this amendatory Act of the 95th
5General Assembly shall develop and implement a policy providing
6for the removal of all social security numbers from all records
7prior to the public display of those records on the website,
8and must file a copy of the policy with the county board of
9that county. Policies pertaining to the removal of social
10security numbers from records to be posted on the internet
11shall be made available to all employees of a county recorder.
12    No person or entity shall include an individual's social
13security number in a document that is prepared and presented
14for recording with a county recorder. This Section shall not
15apply to (i) State or federal tax liens, certified copies of
16death certificates, or other documents required by law to
17contain personal identifying information or (ii) documents
18that were executed by an individual prior to the effective date
19of this amendatory Act of the 95th General Assembly.
20    The recorder shall redact all private information of law
21enforcement personnel from county land records and home sale
22records, and shall not allow access to the information by the
23general public.
24    County recorders shall not be liable for any claims arising
25from unintentional or inadvertent violations of this Section.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
