SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Synthetic Drug Manipulation Emergency Board Act. Provides that the Governor shall appoint the members of the Synthetic Drug Manipulation Emergency Board. Requires that the Board study state laws that ban synthetic drugs, including, but not limited to, K2. Provides that the Board must prepare and submit a report to the Governor and the General Assembly by January 1, 2012 and each January 1 thereafter, recommending specific synthetic drugs that are likely to endanger the public and the best method for banning those synthetic drugs. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Synthetic Drug Manipulation Emergency Board Act.
 
6    Section 5. Establishment of the Board; chairperson.
7    (a) The Synthetic Drug Manipulation Emergency Board is
8established. The Board shall consist of 5 members. The members
9of the Board shall be appointed by the Governor with the advice
10and consent of the Senate. Appointees must be retired judges.
11Of the initial members, 3 shall serve for a 2-year term and 2
12shall serve for a 3-year term, as determined by lot.
13Thereafter, members shall serve for a 4-year term.
14    (b) Members of the Board must be appointed no later than 90
15days after the effective date of this Act.
16    (c) Vacancies shall be filled in the same manner as
17appointments.
18    (d) The Board shall elect one member to serve as the
19chairperson.
 
20    Section 10. Meetings; quorum.
21    (a) The Board must meet at least quarterly and at the call
22of the chairperson.

1    (b) A majority of the members of the Board shall constitute
2a quorum.
 
3    Section 15. Compensation. Members of the Board are not
4entitled to compensation, but are entitled to reimbursement for
5the travel expenses incurred while transacting Board business.
 
6    Section 20. Study; report.
7    (a) The Board must:
8        (1) Study state laws that ban synthetic drugs,
9    including, but not limited to, K2.
10        (2) Research the best method for banning synthetic
11    drugs in order to prevent persons from slightly changing
12    the formula of a substance to avoid violating the ban.
13        (3) Formulate specific recommendations for legislation
14    to ban synthetic drugs that are likely to endanger the
15    public.
16    (b) The Board must prepare and submit a report to the
17Governor and the General Assembly by January 1, 2012 and each
18January 1 thereafter, recommending specific synthetic drugs
19that are likely to endanger the public and the best method for
20banning those synthetic drugs.
 
21    Section 25. Administrative support. The Board shall
22receive administrative and other support from the Department of
23State Police.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
