SYNOPSIS AS INTRODUCED:
 
25 ILCS 150/3  from Ch. 63, par. 106

    Amends the Legislative Audit Commission Act. In provisions concerning the Legislative Audit Commission's review of audit reports relating to agencies under the Governor's jurisdiction, provides that the Legislative Audit Commission shall promptly advise, in writing, the Governor of any areas of disagreement concerning the audit reports. Provides that the advisement must be posted on the Legislative Audit Commission's official Internet website. Provides that the Governor's response to the Legislative Audit Commission's advisement must be made in writing and posted on the Legislative Audit Commission's website. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Legislative Audit Commission Act is amended
5by changing Section 3 as follows:
 
6    (25 ILCS 150/3)  (from Ch. 63, par. 106)
7    Sec. 3. The Commission shall receive the reports of the
8Auditor General and other financial statements and shall
9determine what remedial measures, if any, are needed, and
10whether special studies and investigations are necessary. If
11the Commission shall deem such studies and investigations to be
12necessary, the Commission may direct the Auditor General to
13undertake such studies or investigations.
14    When a disagreement between the Audit Commission and an
15agency under the Governor's jurisdiction arises in the process
16of the Audit Commission's review of audit reports relating to
17such agency, the Audit Commission shall promptly advise, in
18writing, the Governor of such areas of disagreement. Any
19advisement made by the Audit Commission to the Governor under
20this Section must be posted on the Audit Commission's official
21Internet website within 30 days after the advisement is
22submitted to the Governor. The Governor shall respond, in
23writing, to the Audit Commission within a reasonable period of

1time, and in no event later than 60 days, expressing his or her
2views concerning such areas of disagreement and indicating the
3corrective action taken by his or her office with reference
4thereto or, if no action is taken, indicating the reasons
5therefor. The Governor's response to the Audit Commission must
6be posted on the Audit Commission's official Internet website
7within 30 days after the Governor's response is submitted to
8the Audit Commission.
9    The Audit Commission also promptly shall advise all other
10responsible officials of the Executive, Judicial and
11Legislative branches of the State government of areas of
12disagreement arising in the process of the Commission's review
13of their respective audit reports. With reference to his
14particular office, each such responsible official shall
15respond to the Audit Commission within a reasonable period of
16time, and in no event later than 60 days, expressing his view
17concerning such areas of disagreement and indicating the
18corrective action taken with reference thereto or stating the
19reasons that no action has been taken.
20    The Commission shall report its activities to the General
21Assembly including such remedial measures as it deems to be
22necessary. The report of the Commission shall be made to the
23General Assembly not less often than annually and not later
24than March 1 in each year.
25    The requirement for reporting to the General Assembly shall
26be satisfied by filing copies of the report with the Speaker,

1the Minority Leader and the Clerk of the House of
2Representatives and the President, the Minority Leader and the
3Secretary of the Senate and the Legislative Research Unit, as
4required by Section 3.1 of "An Act to revise the law in
5relation to the General Assembly", approved February 25, 1874,
6as amended, and filing such additional copies with the State
7Government Report Distribution Center for the General Assembly
8as is required under paragraph (t) of Section 7 of the State
9Library Act.
10    In addition, the Commission has the powers and duties
11provided for in the "Illinois State Auditing Act", enacted by
12the 78th General Assembly, and, if the provisions of that Act
13are conflict with those of this Act, that Act prevails.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
