SYNOPSIS AS INTRODUCED:

215 ILCS 5/367m new

Amends the Illinois Insurance Code. Provides that beginning January 1, 2012, no group or individual policy of accident and health insurance issued in this State that covers hospital or medical expenses, for an insured or the insured's immediate family or children, shall exclude coverage for any condition defined under the Department of Insurance rules as a pre-existing condition.

A BILL FOR

AN ACT concerning insurance.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Insurance Code is amended by adding Section 367m as follows:

(215 ILCS 5/367m new)

Sec. 367m. Pre-existing condition; exclusion of coverage prohibited. Beginning January 1, 2012, no group or individual policy of accident and health insurance issued in this State that covers hospital or medical expenses, for an insured or the insured's immediate family or children, shall exclude coverage for any condition defined under Department rules as a pre-existing condition.
