Amends the Illinois Literacy Act, the State Finance Act, and the School Code. Provides that the authority of the Secretary of State to award grants that develop, expand, or support adult literacy
programs through community programs
administered by education agencies, libraries, or volunteer or
community-based organizations is transferred
to the State Board of Education on January 1, 2011. Provides that the awarding of grants must be based on documented literacy rate needs in communities.
Provides that moneys in the Secretary of State Special Services Fund and the Live and Learn Fund may be transferred to the Adult Literacy Grant Fund (created as a special fund in the State treasury) for use by the State Board of Education for adult literacy grants. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Literacy Act is amended by changing | 5 | | Section 15 as follows:
| 6 | | (15 ILCS 322/15)
| 7 | | Sec. 15. Grants.
| 8 | | (a) Until January 1, 2011, the The Secretary of State, in | 9 | | consultation with the
Literacy Advisory Board created by | 10 | | Section 7.2 of the State Library Act, is
authorized to
award | 11 | | grants that develop, expand, or support adult literacy
programs | 12 | | in Illinois through community programs
administered by | 13 | | education agencies, libraries, volunteer or
community-based | 14 | | organizations, or a coalition of any of those
groups.
| 15 | | With regard to these grants, on January 1, 2011, all | 16 | | powers, duties, assets, liabilities, contracts, property, | 17 | | records, pending business, and unexpended funds of the | 18 | | Secretary of State are transferred to the State Board of | 19 | | Education. With regard to the grants, beginning on January 1, | 20 | | 2011, references in statutes, rules, forms, and other documents | 21 | | to the Secretary of State shall, in appropriate contexts, be | 22 | | deemed to refer to State Board of Education. All rules, | 23 | | standards, and procedures adopted by the Secretary of State |

| 1 | | with regard to the grants that are in effect on January 1, 2011 | 2 | | shall continue in effect as the rules, standards, and | 3 | | procedures of the State Board of Education until they are | 4 | | amended or repealed by the State Board of Education. | 5 | | (b) The Secretary of State, in consultation with the
| 6 | | Literacy Advisory Board created by Section 7.2 of the State | 7 | | Library Act, is
authorized to
award grants for workplace | 8 | | programs to public or private
employers or entities acting on | 9 | | behalf of a coalition of
employers to improve the basic skills | 10 | | of current and prospective
employees.
Current and prospective | 11 | | employees' lack of basic skills may impede
hiring, effective
| 12 | | job performance, or eligibility for advancement.
Public funds | 13 | | awarded under this grant program must be
matched by the | 14 | | business with funds at least equal to the
amount of public | 15 | | funds awarded.
| 16 | | (c) The Secretary of State is authorized to make family | 17 | | literacy
grants that will assist in breaking the | 18 | | intergenerational
cycle of illiteracy. The grants must involve | 19 | | an adult
literacy component and an entity working with children | 20 | | at
risk of school failure. Programs will focus on
parents or | 21 | | guardians and children involved in reciprocal
learning and | 22 | | teaching.
In addition to other grants authorized in this | 23 | | subsection, the Secretary of
State may make family literacy | 24 | | grants, upon his or her approval of application
from entities, | 25 | | for innovative programming in the area of parent and child
| 26 | | learning activities. The Secretary of State shall establish |

| 1 | | criteria for
awarding the grants by rule. The Secretary of | 2 | | State may expend appropriations
statewide for direct purchases | 3 | | of equipment and services that support families
learning | 4 | | together.

| 6 | | Section 10. The State Finance Act is amended by adding | 7 | | Section 5.755 and by changing Sections 6z-34 and 6z-35 as | 8 | | follows: | 9 | | (30 ILCS 105/5.755 new) | 10 | | Sec. 5.755. The Adult Literacy Grant Fund.

| 12 | | Sec. 6z-34. Secretary of State Special Services Fund. There
| 13 | | is created in the State Treasury a special fund to be known as | 14 | | the Secretary of
State Special Services Fund. Moneys deposited | 15 | | into the Fund may, subject to
appropriation, be used by the | 16 | | Secretary of State for any or all of the
following purposes:
| 17 | | (1) For general automation efforts within operations | 18 | | of the Office of
Secretary of State.
| 19 | | (2) For technology applications in any form that will | 20 | | enhance the
operational capabilities of the Office of | 21 | | Secretary of State.
| 22 | | (3) To provide funds for any type of library grants | 23 | | authorized and
administered by the Secretary of State as |

| 1 | | State Librarian.
| 2 | | These funds are in addition to any other funds otherwise | 3 | | authorized to the
Office of Secretary of State for like or | 4 | | similar purposes.
| 5 | | On August 15, 1997, all fiscal year 1997 receipts that | 6 | | exceed the
amount of $15,000,000 shall be transferred from this | 7 | | Fund to the Statistical
Services Revolving Fund; on August 15, | 8 | | 1998 and each year thereafter
through 2000, all
receipts from | 9 | | the fiscal year ending on the previous June 30th that exceed | 10 | | the
amount of $17,000,000 shall be transferred from this Fund | 11 | | to the Statistical
Services Revolving Fund; on August 15, 2001 | 12 | | and each year thereafter
through 2002, all
receipts from the | 13 | | fiscal year ending on the previous June 30th that exceed the
| 14 | | amount of $19,000,000 shall be transferred from this Fund to | 15 | | the Statistical
Services Revolving Fund; and on August 15, 2003 | 16 | | and each year thereafter, all
receipts from the fiscal year | 17 | | ending on the previous June 30th that exceed the
amount of | 18 | | $33,000,000 shall be transferred from this Fund to the | 19 | | Statistical
Services Revolving Fund.
| 20 | | Beginning with fiscal year 2011, moneys in the Secretary of

| 1 | | Sec. 6z-35.
There is hereby created in the State Treasury a | 2 | | special fund
to be known as the Live and Learn Fund. The | 3 | | Comptroller and the Treasurer
shall transfer $1,742,000 from | 4 | | the General Revenue Fund into the Live and Learn
Fund each | 5 | | month. The first transfer shall be made 60 days after the | 6 | | effective
date of this amendatory Act of 1993, with subsequent | 7 | | transfers occurring on the
first of each month. Moneys | 8 | | deposited into the Fund may, subject to
appropriation, be used | 9 | | by the Secretary of State for any or all of the
following | 10 | | purposes:
| 11 | | (a) An organ donation awareness or education program.
| 12 | | (b) To provide additional funds for all types of | 13 | | library grants as
authorized and administered by the | 14 | | Secretary of State as State Librarian.
| 15 | | Beginning with fiscal year 2011, moneys in the Live and | 16 | | Learn Fund may be transferred to the Adult Literacy Grant Fund | 17 | | for use by the State Board of Education for adult literacy | 18 | | grants under Section 2-3.153 of the School Code. | 19 | | (Source: P.A. 88-78.)

The State | 6 | | Board of Education shall award these grants based on documented | 7 | | literacy rate needs in communities. | 8 | | (b) The Adult Literacy Grant Fund is created as a special | 9 | | fund in the State treasury. All money in the Adult Literacy | 10 | | Grant Fund shall be used, subject to appropriation, by the | 11 | | State Board of Education for grants under this Section.
