SYNOPSIS AS INTRODUCED:
 
105 ILCS 125/3.5 new
30 ILCS 805/8.34 new

    Amends the School Breakfast and Lunch Program Act. Requires a school board (including the board of a private school) that (1) completes a nutritional analysis of traditional or enhanced food-based menu plans as part of the State review process, (2) provides its meals under a nutrient-based menu plan, or (3) uses software that calculates the nutritional content of foods or menus to publish the school lunch menu and the nutrition content, including calories, of each meal item. Provides that all other school boards are strongly encouraged to publish the school lunch menu and the nutrition content, including calories, of each meal item. Provides that a school board may determine the frequency and manner of publication. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Breakfast and Lunch Program Act is
5 amended by adding Section 3.5 as follows:
 
6     (105 ILCS 125/3.5 new)
7     Sec. 3.5. Publication of lunch menu.
8     (a) The General Assembly finds and declares that:
9         (1) Different studies found that African-Americans are
10     from 1.4 to 2.2 times more likely to have diabetes than
11     caucasians.
12         (2) Hispanic-Americans have a higher prevalence of
13     diabetes than non-Hispanic persons, with the highest rates
14     for type 2 diabetes among Puerto Ricans and Hispanic people
15     living in the Southwest and the lowest rate among Cubans.
16         (3) The prevalence of diabetes among American-Indians
17     is 2.8 times the overall rate.
18         (4) Major groups within the Asian and Pacific Islander
19     communities, including Japanese-Americans,
20     Chinese-Americans, Filipino-Americans, and
21     Korean-Americans all had a higher prevalence of diabetes
22     than those of caucasians.
23     (b) A school board that does any one of the following must

1 publish the school lunch menu and the nutrition content,
2 including calories, of each meal item:
3         (1) Completes a nutritional analysis of traditional or
4     enhanced food-based menu plans as part of the State review
5     process.
6         (2) Provides its meals under a nutrient-based menu
7     plan.
8         (3) Uses software that calculates the nutritional
9     content of foods or menus.
10 All other school boards are strongly encouraged to publish the
11 school lunch menu and the nutrition content, including
12 calories, of each meal item.
13     A school board may determine the frequency and manner of
14 publication.
 
15     Section 90. The State Mandates Act is amended by adding
16 Section 8.34 as follows:
 
17     (30 ILCS 805/8.34 new)
18     Sec. 8.34. Exempt mandate. Notwithstanding Sections 6 and 8
19 of this Act, no reimbursement by the State is required for the
20 implementation of any mandate created by this amendatory Act of
21 the 96th General Assembly.
 
22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
