SYNOPSIS AS INTRODUCED:

New Act
30 ILCS 105/5.755 new

Creates the Aerospace Competitiveness Act. Establishes the Illinois Council on Aerospace and provides for its membership. The purpose of the Council is to emulate national and international best practices that will: (1) improve coordination and responsiveness of the State's aerospace training, education, research, and development programs to meet industry needs; (2) enhance the State's economic climate for the industry; and (3) ensure that Illinois remains the best place in the world to design and manufacture aircraft and grow jobs in the aerospace industry. Sets forth the responsibilities of the Council and provides for funding and reports. Amends the State Finance Act to create the Illinois Aerospace Council Fund.

A BILL FOR

AN ACT relating to aerospace competitiveness.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Aerospace Competitiveness Act.

Section 5. Illinois Council on Aerospace.

(a) The Illinois Council on Aerospace is created within the Office of the Governor. The purpose of the Council is to emulate national and international best practices that will:

(1) improve coordination and responsiveness of the State's aerospace training, education, research, and development programs to meet industry needs;

(2) enhance the State's economic climate for the industry; and

(3) ensure that Illinois remains the best place in the world to design and manufacture aircraft and grow jobs in the aerospace industry.

(b) The Council shall be composed of 13 members representing the public and private sectors, as follows:

(1) The 9 public sector members of the Council are: (i) the Director of Commerce and Economic Opportunity, or his or her designee, who shall be the Chair; (ii) the executive director of the Board of Higher Education, or his or her designee; (iii) the director of the Illinois Community College Board, or his or her designee; (iv) the president of the University of Illinois, or his or her designee; (v) the president of Illinois State University, or his or her designee; (vi) one member of the General Assembly appointed by each of the following: the Speaker of the House, the House Minority Leader, the President of the Senate, and the Senate Minority Leader.

(2) The Governor shall appoint each of the following 4 members to 4-year terms as private sector representatives on the Council: (i) one member representing a labor organization of aerospace machinists; (ii) one member representing a labor organization of aerospace engineers; (iii) one member representing the State's largest aerospace manufacturer; and (iv) one member representing aerospace employers.

Section 10. Council; responsibilities.

(a) The Council shall:

(1) Provide counsel and advice to the Governor and the General Assembly on public policies that will strengthen the aerospace industry and support its job growth in Illinois.

(2) Take joint action to integrate training and education with research and development.

(b) With the oversight and guidance of the Council as a whole, its public sector members are charged with the following lead responsibilities, respectively:

(1) The Director of the Illinois Community College Board must ensure coordination of all aerospace training and apprenticeship programs under its authority.

(2) The executive director of the Board of Higher Education must ensure that all degree programs of interest to the aerospace industry are provided by and coordinated among the State's 4-year institutions of higher education.

(3) The presidents of the University of Illinois and Illinois State University must coordinate all aerospace-related research and development activities available through their institutions and ensure that these activities are responsive to the industry's needs.

(4) The Director of Commerce and Economic Opportunity must carry out the State's activities to retain, attract, and grow aerospace companies and jobs.

(c) The Council may consult, as necessary, with the Director of Employment Security and the State Superintendent of Education to assist in the development of policies to carry out the purposes of this Act.

(d) The Council shall meet with the Governor at least twice annually.

(e) Staffing for the Council shall be provided by the Department of Commerce and Economic Opportunity.

(f) Beginning on January 1, 2011, and annually thereafter, the Council shall report to the Governor and the General Assembly on the state of the State's aerospace industry and the activities and accomplishments of the Council in the previous calendar year.

Section 15. Council; funding.

(a) The Council or the organizations represented by its members shall apply for and may receive public and private grants and donations for training, education, research, development, and other activities relevant to the Council's responsibilities under this Act. State and non-State moneys received by the Council for these purposes must be deposited into the Illinois Aerospace Council Fund, a special fund in the State treasury.

(b) For fiscal years 2011 through 2013, increased training, education, research, or development activities approved by the Council shall be supported by federal Workforce Investment Act funds or other discretionary funds administered by the Governor. These funds may be invested independently to support these activities or may be used as match to leverage additional investments.

Section 20. Illinois Aerospace Council Fund. The Illinois Aerospace Council Fund is created as a special fund in the State treasury. Only the Governor or the Chair of the Council may authorize expenditures from the Fund. Expenditures from the Fund may be made only for purposes of this Act. Administrative expenses of the Council, including staff support, may be paid from the Fund. Revenues to the Fund consist of moneys received from grants and donations, funds administered under the Governor's discretion that are deposited into the Fund, and moneys received pursuant to appropriations.

Section 95. The State Finance Act is amended by adding Section 5.755 as follows:
