SYNOPSIS AS INTRODUCED:

55 ILCS 5/5-370012 new

Amends the Counties Code. Provides that the Cook County Health and Hospitals System created by Cook County Ordinance Number 08-O-35 (known as the "Ordinance Establishing the Cook County Health and Hospitals System"), as amended and in effect on December 30, 2009, shall not terminate but shall exist perpetually in that form unless modified by the General Assembly by law. Denies home rule powers. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-370012 as follows:

(55 ILCS 5/5-370012 new)

Sec. 5-370012. Cook County Health and Hospitals System. The Cook County Health and Hospitals System created by Cook County Ordinance Number 08-O-35, known as the "Ordinance Establishing the Cook County Health and Hospitals System", as amended and in effect on December 30, 2009, shall not terminate but shall exist perpetually in that form unless modified by the General Assembly by law.

The regulation of the Cook County Health and Hospitals System is an exclusive power and function of the State. This is a denial and limitation of home rule powers and functions under subsection (h) of Section 6 of Article VII of the Illinois Constitution.

Section 99. Effective date. This Act takes effect upon becoming law.
