    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game to support Illinois Route 66, to commence on July 1, 2009. Provides that the net revenue from the game shall be deposited into the Illinois Route 66 Fund for appropriation by the General Assembly to the Department of Commerce and Economic Opportunity for the purpose of making grants to not-for-profit corporations that have a statewide impact on Illinois Route 66. Amends the State Finance Act to create the Illinois Route 66 Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.9 as follows:
 
6     (20 ILCS 1605/2)  (from Ch. 120, par. 1152)
7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, 21.5, 21.6, 21.7, and 21.8, and 21.9.

16     Sec. 20. State Lottery Fund.
17     (a) There is created in the State Treasury a special fund
18 to be known as the "State Lottery Fund". Such fund shall
19 consist of all revenues received from (1) the sale of lottery
20 tickets or shares, (net of commissions, fees representing those
21 expenses that are directly proportionate to the sale of tickets
22 or shares at the agent location, and prizes of less than $600

1 which have been validly paid at the agent level), (2)
2 application fees, and (3) all other sources including moneys
3 credited or transferred thereto from any other fund or source
4 pursuant to law. Interest earnings of the State Lottery Fund
5 shall be credited to the Common School Fund.
6     (b) The receipt and distribution of moneys under Section
7 21.5 of this Act shall be in accordance with Section 21.5.
8     (c) The receipt and distribution of moneys under Section
9 21.6 of this Act shall be in accordance with Section 21.6.
10     (d) The receipt and distribution of moneys under Section
11 21.7 of this Act shall be in accordance with Section 21.7.
12     (e) The receipt and distribution of moneys under Section
13 21.8 of this Act shall be in accordance with Section 21.8.
14     (f) The receipt and distribution of moneys under Section
15 21.9 of this Act shall be in accordance with Section 21.9.

20     Sec. 21.9. Illinois Route 66 scratch-off game.
21     (a) The Department shall offer a special instant
22 scratch-off game to support Illinois Route 66. The game shall
23 commence on July 1, 2009 or as soon thereafter, in the
24 discretion of the Director, as is reasonably practical. The
25 operation of the game is governed by this Act and by any rules

1 adopted by the Department. If any provision of this Section is
2 inconsistent with any other provision of this Act, then this
3 Section governs.
4     (b) The Illinois Route 66 Fund is created as a special fund
5 in the State treasury. The net revenue from the Illinois Route
6 66 special instant scratch-off game must be deposited into the
7 Fund for appropriation by the General Assembly to the
8 Department of Commerce and Economic Opportunity for the
9 purposes of the Fund.
10     For purposes of this subsection, "net revenue" means the
11 total amount for which tickets have been sold less the sum of
12 the amount paid out in prizes and the actual administrative
13 expenses of the Department solely related to the Illinois Route
14 66 game.
15     (c) During the time that tickets are sold for the Illinois
16 Route 66 game, the Department shall not unreasonably diminish
17 the efforts devoted to marketing any other instant scratch-off
18 lottery game.
19     (d) The Department may adopt any rules necessary to
20 implement and administer the provisions of this Section.
 
21     Section 10. The State Finance Act is amended by adding
22 Sections 5.719 and 6z-76 as follows:

24     Sec. 5.719. The Illinois Route 66 Fund.

2     Sec. 6z-76. Illinois Route 66 Fund. The Illinois Route 66
3 Fund is created as a special fund in the State treasury.
4 Subject to appropriation, the Fund shall be used by the
5 Department of Commerce and Economic Opportunity to make grants
6 to not-for-profit corporations that have a statewide impact on
7 Illinois Route 66 and that maintain, improve, or repair
8 Historic Route 66 in Illinois. Grant moneys may be used for
9 tourism promotion, matching grant funds, project development
10 and implementation, grants to units of local government, and
11 rehabilitation of historic structures.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
