    Amends the Safe and Hygienic Bed Act. Makes a technical change in a Section concerning definitions.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Safe and Hygienic Bed Act is amended by
5 changing Section 5 as follows:
 
6     (410 ILCS 68/5)
7     Sec. 5. Definitions. As used in this Act:
8     "Attorney General" means the the Attorney General of the
9 State of Illinois.
10     "Bedding" means any mattress, box spring, foundation, or
11 studio couch made in whole or part from new or secondhand
12 fabric, filling material, or other textile product or material
13 and which can be used for sleeping or reclining purposes.
14     "Consumer" means a person who purchases or otherwise
15 acquires bedding for sleeping or reclining purposes in that
16 person's home or business such as a medical facility or lodging
17 establishment, and does not include wholesalers, retailers, or
18 other persons who acquire bedding for purposes of resale or
19 other distribution.
20     "Department" means the Illinois Department of Public
21 Health.
22     "Manufacturer" means a person who makes any article of
23 bedding in whole or in part using new or secondhand fabric,

1 filling material, or other textile product or material.
2     "New material" means any fabric, filling material, other
3 textile product or material, or article of bedding that has not
4 been previously used for any purpose, and includes by-products
5 of any textile or manufacturing process that are free from
6 dirt, insects, and other contamination.
7     "Person" means an individual, sole proprietorship,
8 partnership, limited liability company, corporation, joint
9 venture, association, trust, and any other entity, and the
10 officers, employees, and agents of any of them.
11     "Renovator", "Rebuilder", and "Repairer" mean a person who
12 repairs, makes over, recovers, restores, sanitizes,
13 germicidally treats, cleans, or renews bedding.
14     "Sanitizer" means any person who sanitizes or germicidally
15 treats or cleans (but does not otherwise alter) any fabric,
16 filling material, other textile product or material, or article
17 of bedding for use in manufacturing or renovating bedding.
18     "Secondhand material" means any fabric, filling material,
19 other textile product or material, or article of bedding that
20 has been previously used for any purpose or that is derived
21 from post-consumer or industrial waste, and that may be used in
22 place of or in addition to new material in manufacturing or
23 renovating bedding.
