SYNOPSIS AS INTRODUCED:
 
820 ILCS 55/11 new

    Amends the Right to Privacy in the Workplace Act. Provides that it is unlawful for an employer to procure a consumer report for employment purposes where any information contained in the consumer report bears on an individual's creditworthiness, credit standing, or credit capacity. Provides that the prohibition does not apply if the information is substantially job related and the employer's reasons for the use of the information are disclosed to the individual in writing or the information is required by law. Effective immediately.

1     AN ACT concerning employment.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Right to Privacy in the Workplace Act is
5 amended by adding Section 11 as follows:
 
6     (820 ILCS 55/11 new)
7     Sec. 11. Consumer reports.
8     (a) As used in this Section:
9     "Employment purposes" and "consumer report" have the
10 meanings ascribed to those terms in 15 U.S.C. 1681a.
11     "Individual" includes employees and applicants for
12 employment.
13     (b) It is unlawful for an employer to procure a consumer
14 report for employment purposes where any information contained
15 in the consumer report bears on an individual's
16 creditworthiness, credit standing, or credit capacity unless
17 the information is:
18         (1) substantially job related and the employer's
19     reasons for the use of the information are disclosed to the
20     individual in writing; or
21         (2) required by law.
 
22     Section 99. Effective date. This Act takes effect upon
