SYNOPSIS AS INTRODUCED:

    Amends the Chicago Firefighter Article of the Illinois Pension Code. Changes the amount of a widow's annuity for a deceased fireman that was receiving a retirement annuity at the time of his death to the greater of 50% of the amount of such retirement annuity at the time of the fireman's death or the salary of an active firefighter with 5 years of service at the time of the fireman's death. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by changing
5 Section 6-141.1 as follows:
 
6     (40 ILCS 5/6-141.1)  (from Ch. 108 1/2, par. 6-141.1)
7     Sec. 6-141.1. Widow's annuity; death after June 30, 1984.
8     (a) Notwithstanding the other provisions of this Article,
9 the widow of a fireman who dies on or after June 30, 1984,
10 while receiving a retirement annuity or while an active fireman
11 with at least 1 1/2 years of creditable service, may elect to
12 have the amount of widow's annuity calculated in accordance
13 with this Section.
14     (b) If the deceased fireman was an active fireman at the
15 time of his death and had at least 1 1/2 years of creditable
16 service, the widow's annuity shall be the greater of (1) 30% of
17 the salary attached to the rank of first class firefighter in
18 the classified career service at the time of the fireman's
19 death, or (2) 50% of the retirement annuity the deceased
20 fireman would have been eligible to receive if he had retired
21 from service on the day before his death.
22     (c) If the deceased fireman was receiving a retirement
23 annuity at the time of his death, the widow's annuity shall be

1 equal to the greater of 50% of the amount of such retirement
2 annuity at the time of the fireman's death or the salary of an
3 active firefighter with 5 years of service at the time of the
4 fireman's death.
5     (d) The changes made to this Section by this amendatory Act
6 of the 95th General Assembly apply without regard to whether
7 the fireman was in service on or after its effective date. In
8 the case of person who is receiving a widow's annuity on the
9 effective date of this amendatory Act of the 95th General
10 Assembly, the increase, if any, shall begin to accrue on the
11 first benefit payment date following the effective date.

13     Section 90. The State Mandates Act is amended by adding
14 Section 8.32 as follows:
 
15     (30 ILCS 805/8.32 new)
16     Sec. 8.32. Exempt mandate. Notwithstanding Sections 6 and 8
17 of this Act, no reimbursement by the State is required for the
18 implementation of any mandate created by this amendatory Act of
19 the 95th General Assembly.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
