1     AN ACT concerning education.
 
2     WHEREAS, The General Assembly finds and declares the
3 following:
4         (a) Illinois has over one million deaf and hard of
5     hearing residents;
6         (b) American Sign Language (ASL) is a fully-developed,
7     visual-gestural language with distinct grammar, syntax,
8     and symbols and is one of hundreds of signed languages in
9     the world;
10         (c) The American deaf community is a group of citizens
11     who are members of a unique culture who share ASL as their
12     common language; and
13         (d) High school graduation requirements under Section
14     27-22 of the School Code require students to take one year
15     of music, art, vocational education, or a foreign language,
16     which includes ASL; and
 
17     WHEREAS, The General Assembly hereby also declares the
18 purpose and intent of this amendatory Act to be as follows:
19         (a) To recognize ASL as the language of the American
20     deaf community; and
21         (b) To authorize and encourage public and independent
22     schools, including post-secondary schools, to offer ASL as
23     a course of study and to accept ASL credits as
24     foreign-language credits; therefore

1     Be it enacted by the People of the State of Illinois,
2 represented in the General Assembly:
 
3     Section 5. The School Code is amended by adding Sections
4 10-20.46 and 34-18.37 as follows:
 
5     (105 ILCS 5/10-20.46 new)
6     Sec. 10-20.46. American Sign Language courses. School
7 boards are encouraged to implement American Sign Language
8 courses into school foreign language curriculum.
9 Notwithstanding any other rulemaking authority that may exist,
10 neither the Governor nor any agency or agency head under the
11 jurisdiction of the Governor has any authority to make or
12 promulgate rules to implement or enforce the provisions of this
13 amendatory Act of the 95th General Assembly. If, however, the
14 Governor believes that rules are necessary to implement or
15 enforce the provisions of this amendatory Act of the 95th
16 General Assembly, the Governor may suggest rules to the General
17 Assembly by filing them with the Clerk of the House and the
18 Secretary of the Senate and by requesting that the General
19 Assembly authorize such rulemaking by law, enact those
20 suggested rules into law, or take any other appropriate action
21 in the General Assembly's discretion. Nothing contained in this
22 amendatory Act of the 95th General Assembly shall be
23 interpreted to grant rulemaking authority under any other
24 Illinois statute where such authority is not otherwise

2 the 95th General Assembly, "rules" is given the meaning
3 contained in Section 1-70 of the Illinois Administrative

6 Administrative Procedure Act to the extent that such
7 definitions apply to agencies or agency heads under the
8 jurisdiction of the Governor.
 
9     (105 ILCS 5/34-18.37 new)
10     Sec. 34-18.37. American Sign Language courses. The school
11 board is encouraged to implement American Sign Language courses
12 into school foreign language curriculum. Notwithstanding any
13 other rulemaking authority that may exist, neither the Governor
14 nor any agency or agency head under the jurisdiction of the
15 Governor has any authority to make or promulgate rules to
16 implement or enforce the provisions of this amendatory Act of
17 the 95th General Assembly. If, however, the Governor believes
18 that rules are necessary to implement or enforce the provisions
19 of this amendatory Act of the 95th General Assembly, the
20 Governor may suggest rules to the General Assembly by filing
21 them with the Clerk of the House and the Secretary of the
22 Senate and by requesting that the General Assembly authorize
23 such rulemaking by law, enact those suggested rules into law,
24 or take any other appropriate action in the General Assembly's
25 discretion. Nothing contained in this amendatory Act of the

1 95th General Assembly shall be interpreted to grant rulemaking
2 authority under any other Illinois statute where such authority
3 is not otherwise explicitly given. For the purposes of this
4 amendatory Act of the 95th General Assembly, "rules" is given
5 the meaning contained in Section 1-70 of the Illinois
6 Administrative Procedure Act, and "agency" and "agency head"
7 are given the meanings contained in Sections 1-20 and 1-25 of
8 the Illinois Administrative Procedure Act to the extent that
9 such definitions apply to agencies or agency heads under the
10 jurisdiction of the Governor.
 
11     Section 10. The University of Illinois Act is amended by
12 changing Section 8 and by adding Section 40 as follows:
 
13     (110 ILCS 305/8)  (from Ch. 144, par. 29)
14     Sec. 8. Admissions.
15     (a) No student shall be admitted to instruction in any of
16 the departments of the University who shall not have attained
17 to the age of fifteen (15) years, and who shall not previously
18 undergo a satisfactory examination in each of the branches
19 ordinarily taught in the common schools of the state.
20     (b) In addition, commencing in the fall of 1993, no new
21 student shall then or thereafter be admitted to instruction in
22 any of the departments or colleges of the University unless
23 such student also has satisfactorily completed:
24         (1) at least 15 units of high school coursework from

1     the following 5 categories:
2             (A) 4 years of English (emphasizing written and
3         oral communications and literature), of which up to 2
4         years may be collegiate level instruction;
5             (B) 3 years of social studies (emphasizing history
6         and government);
7             (C) 3 years of mathematics (introductory through
8         advanced algebra, geometry, trigonometry, or
9         fundamentals of computer programming);
10             (D) 3 years of science (laboratory sciences); and
11             (E) 2 years of electives in foreign language, which
12         shall be deemed to include American Sign Language,
13         music, vocational education or art;
14         (2) except that institutions may admit individual
15     applicants if the institution determines through
16     assessment or through evaluation based on learning
17     outcomes of the coursework taken, including vocational
18     education courses and courses taken in a charter school
19     established under Article 27A of the School Code, that the
20     applicant demonstrates knowledge and skills substantially
21     equivalent to the knowledge and skills expected to be
22     acquired in the high school courses required for admission.
23     The Board of Trustees of the University of Illinois shall
24     not discriminate in the University's admissions process
25     against an applicant for admission because of the
26     applicant's enrollment in a charter school established

1     under Article 27A of the School Code. Institutions may also
2     admit 1) applicants who did not have an opportunity to
3     complete the minimum college preparatory curriculum in
4     high school, and 2) educationally disadvantaged applicants
5     who are admitted to the formal organized special assistance
6     programs that are tailored to the needs of such students,
7     providing that in either case, the institution
8     incorporates in the applicant's baccalaureate curriculum
9     courses or other academic activities that compensate for
10     course deficiencies; and
11         (3) except that up to 3 of the 15 units of coursework
12     required by paragraph (1) of this subsection may be
13     distributed by deducting no more than one unit each from
14     the categories of social studies, mathematics, sciences
15     and electives and completing those 3 units in any of the 5
16     categories of coursework described in paragraph (1).
17     Notwithstanding any other rulemaking authority that may
18 exist, neither the Governor or University nor any agency or
19 agency head under the jurisdiction of the Governor has any
20 authority to make or promulgate rules to implement or enforce
21 the provisions of this amendatory Act of the 95th General
22 Assembly. If, however, the Governor or University believes that
23 rules are necessary to implement or enforce the provisions of
24 this amendatory Act of the 95th General Assembly, the Governor
25 or University may suggest rules to the General Assembly by
26 filing them with the Clerk of the House and the Secretary of

1 the Senate and by requesting that the General Assembly
2 authorize such rulemaking by law, enact those suggested rules
3 into law, or take any other appropriate action in the General

6 rulemaking authority under any other Illinois statute where
7 such authority is not otherwise explicitly given. For the
8 purposes of this amendatory Act of the 95th General Assembly,
9 "rules" is given the meaning contained in Section 1-70 of the
10 Illinois Administrative Procedure Act, and "agency" and
11 "agency head" are given the meanings contained in Sections 1-20
12 and 1-25 of the Illinois Administrative Procedure Act to the
13 extent that such definitions apply to agencies or agency heads
14 under the jurisdiction of the Governor.
15     (c) When allocating funds, local boards of education shall
16 recognize their obligation to their students to offer the
17 coursework required by subsection (b).
18     (d) A student who has graduated from high school and has
19 scored within the University's accepted range on the ACT or SAT
20 shall not be required to take the high school level General
21 Educational Development (GED) Test as a prerequisite to
22 admission.

2 any American Sign Language course offered or approved by the
3 University, which may be applied toward the satisfaction of the
4 foreign language requirements of the University, except for
5 those requirements related to the content of a student's
6 academic major. Notwithstanding any other rulemaking authority
7 that may exist, neither the Governor or University nor any
8 agency or agency head under the jurisdiction of the Governor
9 has any authority to make or promulgate rules to implement or
10 enforce the provisions of this amendatory Act of the 95th
11 General Assembly. If, however, the Governor or University
12 believes that rules are necessary to implement or enforce the
13 provisions of this amendatory Act of the 95th General Assembly,
14 the Governor or University may suggest rules to the General
15 Assembly by filing them with the Clerk of the House and the

5     Section 15. The Southern Illinois University Management
6 Act is amended by changing Section 8e and by adding Section 25
7 as follows:
 
8     (110 ILCS 520/8e)  (from Ch. 144, par. 658e)
9     Sec. 8e. Admissions.
10     (a) Commencing in the fall of 1993, no new student shall
11 then or thereafter be admitted to instruction in any of the
12 departments or colleges of the University unless such student
13 also has satisfactorily completed:
14         (1) at least 15 units of high school coursework from
15     the following 5 categories:
16             (A) 4 years of English (emphasizing written and
17         oral communications and literature), of which up to 2
18         years may be collegiate level instruction;
19             (B) 3 years of social studies (emphasizing history
20         and government);
21             (C) 3 years of mathematics (introductory through
22         advanced algebra, geometry, trigonometry, or

21         oral communications and literature), of which up to 2
22         years may be collegiate level instruction;
23             (B) 3 years of social studies (emphasizing history

19     (b) When allocating funds, local boards of education shall
20 recognize their obligation to their students to offer the
21 coursework required by subsection (a).
22     (c) A student who has graduated from high school and has
23 scored within the University's accepted range on the ACT or SAT
24 shall not be required to take the high school level General
25 Educational Development (GED) Test as a prerequisite to

3     Sec. 30-145. American Sign Language courses. The
4 University shall award academic credit for the successful
5 completion of any American Sign Language course offered or
6 approved by the University, which may be applied toward the
7 satisfaction of the foreign language requirements of the
8 University, except for those requirements related to the
9 content of a student's academic major. Notwithstanding any
10 other rulemaking authority that may exist, neither the Governor
11 or University nor any agency or agency head under the
12 jurisdiction of the Governor has any authority to make or
13 promulgate rules to implement or enforce the provisions of this
14 amendatory Act of the 95th General Assembly. If, however, the
15 Governor or University believes that rules are necessary to
16 implement or enforce the provisions of this amendatory Act of
17 the 95th General Assembly, the Governor or University may
18 suggest rules to the General Assembly by filing them with the
19 Clerk of the House and the Secretary of the Senate and by
20 requesting that the General Assembly authorize such rulemaking
21 by law, enact those suggested rules into law, or take any other
22 appropriate action in the General Assembly's discretion.
23 Nothing contained in this amendatory Act of the 95th General
24 Assembly shall be interpreted to grant rulemaking authority

9     Section 50. The Western Illinois University Law is amended
10 by changing Section 35-85 and by adding Section 35-140 as
11 follows:
 
12     (110 ILCS 690/35-85)
13     Sec. 35-85. Admission requirements.
14     (a) No new student shall be admitted to instruction in any
15 of the departments or colleges of the Western Illinois
16 University unless such student also has satisfactorily
17 completed:
18         (1) at least 15 units of high school coursework from
19     the following 5 categories:
20             (A) 4 years of English (emphasizing written and
21         oral communications and literature), of which up to 2
22         years may be collegiate level instruction;
23             (B) 3 years of social studies (emphasizing history
24         and government);

1             (C) 3 years of mathematics (introductory through
2         advanced algebra, geometry, trigonometry, or
3         fundamentals of computer programming);
4             (D) 3 years of science (laboratory sciences); and
5             (E) 2 years of electives in foreign language, which
6         shall be deemed to include American Sign Language,
7         music, vocational education or art;
8         (2) except that Western Illinois University may admit
9     individual applicants if it determines through assessment
10     or through evaluation based on learning outcomes of the
11     coursework taken, including vocational education courses
12     and courses taken in a charter school established under
13     Article 27A of the School Code, that the applicant
14     demonstrates knowledge and skills substantially equivalent
15     to the knowledge and skills expected to be acquired in the
16     high school courses required for admission. The Board of
17     Trustees of Western Illinois University shall not
18     discriminate in the University's admissions process
19     against an applicant for admission because of the
20     applicant's enrollment in a charter school established
21     under Article 27A of the School Code. Western Illinois
22     University may also admit (i) applicants who did not have
23     an opportunity to complete the minimum college preparatory
24     curriculum in high school, and (ii) educationally
25     disadvantaged applicants who are admitted to the formal
26     organized special assistance programs that are tailored to

1     the needs of such students, providing that in either case,
2     the institution incorporates in the applicant's
3     baccalaureate curriculum courses or other academic
4     activities that compensate for course deficiencies; and
5         (3) except that up to 3 of 15 units of coursework
6     required by paragraph (1) of this subsection may be
7     distributed by deducting no more than one unit each from
8     the categories of social studies, mathematics, sciences
9     and electives and completing those 3 units in any of the 5
10     categories of coursework described in paragraph (1).
11     Notwithstanding any other rulemaking authority that may
12 exist, neither the Governor or University nor any agency or
13 agency head under the jurisdiction of the Governor has any
14 authority to make or promulgate rules to implement or enforce
15 the provisions of this amendatory Act of the 95th General
16 Assembly. If, however, the Governor or University believes that
17 rules are necessary to implement or enforce the provisions of
18 this amendatory Act of the 95th General Assembly, the Governor
19 or University may suggest rules to the General Assembly by
20 filing them with the Clerk of the House and the Secretary of
21 the Senate and by requesting that the General Assembly
22 authorize such rulemaking by law, enact those suggested rules
23 into law, or take any other appropriate action in the General
24 Assembly's discretion. Nothing contained in this amendatory
25 Act of the 95th General Assembly shall be interpreted to grant

5 successful completion of any American Sign Language course
6 offered or approved by a community college, which may be
7 applied toward the satisfaction of any foreign language
8 requirements of the community college, except for those
9 requirements related to the content of a student's academic
10 major. Notwithstanding any other rulemaking authority that may
11 exist, neither the Governor nor any agency or agency head under
12 the jurisdiction of the Governor has any authority to make or
13 promulgate rules to implement or enforce the provisions of this
14 amendatory Act of the 95th General Assembly. If, however, the
15 Governor believes that rules are necessary to implement or
16 enforce the provisions of this amendatory Act of the 95th
17 General Assembly, the Governor may suggest rules to the General
18 Assembly by filing them with the Clerk of the House and the
19 Secretary of the Senate and by requesting that the General
20 Assembly authorize such rulemaking by law, enact those
21 suggested rules into law, or take any other appropriate action
