1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Sections 24-3.5-1 and 24-3.7 as follows:
 
6     (720 ILCS 5/24-3.5-1 new)
7     Sec. 24-3.5-1. Sale or gift of firearm to persons
8 ineligible. A person is guilty of a Class X felony if he or
9 she:
10     (1) has been convicted of the offense of unlawful purchase
11 of a firearm under Section 24-3.5 of this Code; and
12     (2) sells or gives a firearm to any person not eligible to
13 own or possess a firearm under State or federal law; and
14     (3) the person who is not eligible to own or possess a
15 firearm under State or federal law either commits a forcible
16 felony or an act of armed violence under Article 33A of this
17 Code.
 
18     (720 ILCS 5/24-3.7 new)
19     Sec. 24-3.7. Unlawful transfer of a firearm.
20     (a) A person commits the offense of unlawful transfer of a
21 firearm when he or she is not eligible to own or possess a
22 firearm under State or federal law and sells or gives a firearm

1 to another person who is not eligible to own or possess a
2 firearm under State or federal law and that person who is not
3 eligible to own or possess a firearm under State or federal law
4 does any of the following acts:
5         (1) commits a forcible felony;
6         (2) commits an act of armed violence under Article 33A
7     of this Code; or
8         (3) possesses the firearm while in possession of any
9     controlled substance.
10     (b) Sentence. Unlawful transfer of a firearm is a Class X
11 felony.
