SYNOPSIS AS INTRODUCED:
 
New Act
5 ILCS 80/4.28 new

    Creates the Registered Medical Transcriptionist Act. Provides for the registration of medical transcriptionists by the Department of Financial and Professional Regulation. Grants rulemaking authority to the Department. Amends the Regulatory Sunset Act to provide for the repeal of the Registered Medical Transcriptionist Act on January 1, 2018.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Registered Medical Transcriptionist Act.
 
6     Section 5. Purpose. The practice of medical transcription
7 in the State of Illinois is hereby declared to affect the
8 public health, safety, and welfare and to be subject to
9 regulation and control in the public interest. It is further
10 declared to be a matter of public interest and concern that the
11 medical transcriptionist profession merit and receive the
12 confidence of the public and that only qualified persons be
13 permitted to practice this profession in the State of Illinois.
14 This Act shall be liberally construed to carry out these
15 objectives and purposes.
 
16     Section 10. Definitions. As used in this Act:
17     "Department" means the Department of Financial and
18 Professional Regulation.
19     "Medical transcription" means the interpretation,
20 translation, and recording of clinical information dictated by
21 physicians and other healthcare professionals regarding
22 patient assessments, workups, therapeutic procedures, clinical

1 courses, diagnoses, prognoses, and treatments for the
2 production of a clinically accurate and legally sound medical
3 record that can be relied upon for patient safety, continuity
4 of care, risk management, and maximized reimbursement.
5 "Medical transcription" includes the editing of text that has
6 been produced by speech recognition, which requires listening
7 to dictation while reading a draft created via speech
8 recognition technology and editing via computer and may range
9 from minimal to extensive, depending on the capabilities of the
10 speech recognition software and the dictating habits of the
11 originator and includes correction of content as well as
12 punctuation, grammar, and style.
13     "Medical transcriptionist" means an individual registered
14 by the Department under this Act to engage in the practice of
15 medical transcription.
 
16     Section 15. Exemptions. This Act does not apply to any of
17 the following:
18         (1) An authorized representative of the United States
19     government, the State of Illinois, or any city, village,
20     incorporated town, county, township, or other municipal or
21     political corporation or subdivision of this State.
22         (2) Officers of a court when acting within the scope of
23     office.
24         (3) A person licensed, registered, or certified in this
25     State under any other Act who is engaging in the practice

1     for which he or she is licensed, registered, or certified.
 
2     Section 20. Unlawful practice. It is unlawful for any
3 person to engage in the practice or act in the capacity of a
4 medical transcriptionist without having been duly registered
5 by the Department under the provisions of this Act, except as
6 otherwise provided in this Act.
 
7     Section 25. Application. Each applicant for initial
8 registration as a medical transcriptionist must submit an
9 application in writing to the Department on a form containing
10 information prescribed by the Department, which must include an
11 applicant's name, address, and telephone number, and
12 accompanied by a fee established by the Department.
 
13     Section 30. License expiration; renewal. A certificate of
14 registration issued by the Department under this Act shall
15 expire every 2 years from the date of issuance.
16     Upon expiration, a registrant may renew his or her
17 certificate of registration in a form and manner prescribed by
18 the Department.
 
19     Section 35. Rulemaking. The Department may adopt any rules
20 and procedures necessary for the administration and
21 enforcement of this Act.

1     Section 90. The Regulatory Sunset Act is amended by adding
2 Section 4.28 as follows:
 
3     (5 ILCS 80/4.28 new)
4     Sec. 4.28. Act repealed on January 1, 2018. The following
5 Act is repealed on January 1, 2018:
6     The Registered Medical Transcriptionist Act.
