SYNOPSIS AS INTRODUCED:
 
New Act
5 ILCS 80/4.28 new

    Creates the Midwife Certification Act to provide for the regulation of Certified Midwives who practice home-birth midwifery by the Department of Financial and Professional Regulation. Grants rulemaking authority to the Department. Amends the Regulatory Sunset Act to set a repeal date of January 1, 2018 for the new Act.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Midwife Certification Act.
 
6     Section 5. Purpose. The purpose of this Act to regulate the
7 practice of home-birth midwifery and to instill confidence in
8 Illinois families that desire home births that their midwife
9 has been medically trained in appropriate home birth
10 procedures.
 
11     Section 10. Definitions. In this Act:
12     "Department" means the Department of Financial and
13 Professional Regulation.
14     "Midwifery" means the provision, on a continuing basis, of
15 the necessary care and education to women during pregnancy,
16 labor, and the postpartum and interpartum periods; attending
17 deliveries that the individual is responsible for; and caring
18 for the newborn infant. "Midwifery" also includes the provision
19 of additional primary health care services to women and their
20 families, which include, but are not limited to, well-woman
21 gynecological services such as non-pharmacological family
22 planning and routine pap smears.

1     Section 15. Certification required. No person may practice
2 midwifery in a home-birth setting in this State without being
3 certified by the Department under this Act.
 
4     Section 20. Application; qualifications.
5     (a) Application for original certification under this Act
6 must be made to the Department in the form and manner
7 prescribed by the Department and must be accompanied by the
8 appropriate documentation and the required fee.
9     (b) An applicant is qualified for certification under this
10 Act if he or she:
11         (1) has received the designation of "Certified
12     Midwife" from an accredited institution approved by the
13     American College of Nurse-Midwives; and
14         (2) meets all other qualifications required by the
15     Department by rule.
 
16     Section 25. Rulemaking. The Department of Financial and
17 Professional Regulation shall adopt rules necessary for the
18 implementation and administration of this Act, including
19 without limitation rules concerning certificate
20 qualifications; disciplinary action; and enforcement of this
21 Act.
 
22     Section 90. The Regulatory Sunset Act is amended by adding

1 Section 4.28 as follows:
 
2     (5 ILCS 80/4.28 new)
3     Sec. 4.28. Act repealed on January 1, 2018. The following
4 Act is repealed on January 1, 2018:
5     The Midwife Certification Act.
