SYNOPSIS AS INTRODUCED:
 
20 ILCS 2640/10

    Amends the Statewide Organized Gang Database Act. Requires the Department of State Police to develop a standardized, state-wide gang reporting system. Provides that the system must record gang members and gang activity and facilitate the arrest and prosecution of gang members.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Statewide Organized Gang Database Act is
5 amended by changing Section 10 as follows:
 
6     (20 ILCS 2640/10)
7     Sec. 10. Duties of the Department. The Department may:
8     (a) provide a uniform reporting format for the entry of
9 pertinent information regarding the report of an arrested
10 organized gang member or organized gang affiliate into SWORD;
11     (b) notify all law enforcement agencies that reports of
12 arrested organized gang members or organized gang affiliates
13 shall be entered into the database as soon as the minimum level
14 of data specified by the Department is available to the
15 reporting agency, and that no waiting period for the entry of
16 that data exists;
17     (c) develop and implement a policy for notifying law
18 enforcement agencies of the emergence of new organized gangs,
19 or the change of a name or other identifying sign by an
20 existing organized gang;
21     (d) compile and retain information regarding organized
22 gangs and their members and affiliates, in a manner that allows
23 the information to be used by law enforcement and other

1 agencies, deemed appropriate by the Director, for
2 investigative purposes;
3     (e) compile and maintain a historic data repository
4 relating to organized gangs and their members and affiliates in
5 order to develop and improve techniques utilized by law
6 enforcement agencies and prosecutors in the investigation,
7 apprehension, and prosecution of members and affiliates of
8 organized gangs;
9     (f) create a quality control program regarding
10 confirmation of organized gang membership and organized gang
11 affiliation data, timeliness and accuracy of information
12 entered into SWORD, and performance audits of all entering
13 agencies;
14     (g) locate all law enforcement agencies that could, in the
15 opinion of the Director, benefit from access to SWORD, and
16 notify them of its existence; and
17     (h) cooperate with all law enforcement agencies wishing to
18 gain access to the SWORD system, and facilitate their entry
19 into the system and their continued maintenance of access to
20 it; and .
21     (i) develop a standardized, state-wide gang reporting
22 system that records gang members and gang activity and
23 facilitates the arrest and prosecution of gang members.
