SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/33G-1 new
720 ILCS 5/33G-5 new
720 ILCS 5/33G-10 new
720 ILCS 5/33G-15 new

    Amends the Criminal Code of 1961. Provides that a person who engages in a pattern of criminal offenses in 2 or more counties of this State or who attempts or conspires with other persons to engage in a pattern of criminal offenses is guilty of a Class 4 felony. Defines "pattern of criminal offenses" as (1) two or more criminal offenses committed as part of the same plan, scheme, or adventure; (2) a sequence of 2 or more of the same criminal offenses committed that are not separated by an interval of more than 30 days between each offense; or (3) 2 or more criminal offenses committed, each proceeding from or having as an antecedent element a single prior incident or pattern the elements of which constitute the offense of deceptive practices, robbery, burglary, theft, identity theft, false personation, certain violations of the Illinois Credit Card and Debit Card Act, or of the Illinois Identification Card Act. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Article 33G as follows:

PATTERN OF CRIMINAL OFFENSES

 
7     (720 ILCS 5/33G-1 new)
8     Sec. 33G-1. Short title. This Article may be cited as the
9 Pattern of Criminal Offenses Law.
 
10     (720 ILCS 5/33G-5 new)
11     Sec. 33G-5. Definitions. In this Article, "pattern of
12 criminal offenses" means:
13     (1) 2 or more criminal offenses committed as part of the
14 same plan, scheme, or adventure;
15     (2) a sequence of 2 or more of the same criminal offenses
16 committed that are not separated by an interval of more than 30
17 days between each offense; or
18     (3) 2 or more criminal offenses committed, each proceeding
19 from or having as an antecedent element a single prior incident
20 or pattern the elements of which constitute the offense of
21 deceptive practices, robbery, burglary, theft, identity theft,
22 false personation, a violation of Section 8 of the Illinois
23 Credit Card and Debit Card Act, or a violation of Section 14B
24 of the Illinois Identification Card Act.

26     Sec. 33G-10. Pattern of criminal offenses.
27     (a) A person who engages in a pattern of criminal offenses
28 in 2 or more counties of this State or who attempts or
29 conspires with other persons to engage in a pattern of criminal

1 offenses is guilty of a Class 4 felony.
2     (b) The penalty imposed for a violation of this Section
3 shall be in addition to any other penalty imposed for any
4 offense involved in the pattern of criminal offenses.
5     (c) Double jeopardy attaches upon conviction of a person
6 who engages in a pattern of criminal offenses.
 
7     (720 ILCS 5/33G-15 new)
8     Sec. 33G-15. Venue. The offense of engaging in a pattern of
9 criminal offenses or any inchoate offense arising from that
10 offense may be tried in any county in which any of the criminal
11 offenses that constitute an element of the pattern of criminal
12 offenses has occurred.
 
13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
