1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Unified Code of Corrections is amended by
5 changing Section 5-4-3a as follows:
 
6     (730 ILCS 5/5-4-3a)
7     Sec. 5-4-3a. DNA testing backlog accountability.
8     (a) On or before February 1, 2005 and on or before August
9 February 1 of each year thereafter, the Department of State
10 Police shall report to the Governor and both houses of the
11 General Assembly the following information:
12         (1) the extent of the backlog of cases awaiting testing
13     or awaiting DNA analysis by that Department, including but
14     not limited to those tests conducted under Section 5-4-3,
15     as of June 30 December 31 of the previous fiscal year, with
16     the backlog being defined as all cases awaiting forensic
17     testing whether in the physical custody of the State Police
18     or in the physical custody of local law enforcement,
19     provided that the State Police have written notice of any
20     evidence in the physical custody of local law enforcement
21     prior to June 1 of that year; and
22         (2) what measures have been and are being taken to
23     reduce that backlog and the estimated costs or expenditures
24     in doing so.
25     (b) The information reported under this Section shall be
26 made available to the public, at the time it is reported, on
27 the official web site of the Department of State Police.

29     Section 99. Effective date. This Act takes effect upon
30 becoming law.
