    Amends various Acts relating to the governance of the public universities in Illinois. Provides that the board of trustees of each university shall offer 100% tuition discounts (instead of 50% tuition waivers) for undergraduate education to the children of employees who have been employed by any one or more of these universities for at least 7 years. Requires 100% tuition discounts to also be offered to the spouses and domestic partners of these employees. Includes retired employees as university employees for the purpose of these provisions. Effective immediately.

1     AN ACT relating to higher education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The University of Illinois Act is amended by
5 changing Section 7f as follows:
 
6     (110 ILCS 305/7f)  (from Ch. 144, par. 28f)
7     Sec. 7f. Full tuition discount Partial tuition waivers.
8     (a) As used in this Section, "Illinois college or
9 university" means any of the following: the University of
10 Illinois, Southern Illinois University, Chicago State
11 University, Eastern Illinois University, Governors State
12 University, Illinois State University, Northeastern Illinois
13 University, Northern Illinois University, and Western Illinois
14 University.
15     (b) Each year the Board of Trustees of the University of
16 Illinois shall offer 100% tuition discounts 50% tuition waivers
17 for undergraduate education at any campus under its governance
18 or supervision to the children, spouses, and domestic partners
19 of employees, including retired employees, of an Illinois
20 college or university who have been employed by any one or by
21 more than one Illinois college or university for an aggregate
22 period of at least 7 years. "Domestic partner" means 2
23 individuals of the same gender who (1) live together in a
24 long-term relationship of indefinite duration; (2) have
25 resided together at the same address for at least 12 months;
26 (3) are not related by blood to a degree of closeness that
27 would prohibit legal marriage in the state in which they
28 legally reside; (4) are not married to any other person; and
29 (5) have an exclusive mutual commitment in which they agree to
30 be jointly responsible for each other's common welfare and to
31 share financial obligations. "Retired employee" means a person
32 receiving a retirement or disability retirement annuity under

1 the Illinois Pension Code based on at least 7 years of service
2 with one or more than one Illinois college or university,
3 including a person who already is receiving such an annuity on
4 the effective date of this amendatory Act of the 94th General
5 Assembly.
6     To be eligible to receive a full tuition discount partial
7 tuition waiver, the person child of an employee of an Illinois
8 college or university (i) if a child, must be under the age of
9 25 at the commencement of the academic year during which the
10 full tuition discount partial tuition waiver is to be
11 effective, and (ii) must qualify for admission to the
12 University of Illinois under the same admissions requirements,
13 standards and policies which the University of Illinois applies
14 to applicants for admission generally to its respective
15 undergraduate colleges and programs.
16     (c) Subject to the provisions and limitations of subsection
17 (b), an eligible applicant who has continued to maintain
18 satisfactory academic progress toward graduation may have his
19 or her full tuition discount partial tuition waiver renewed
20 until the time as he or she has expended 4 years of
21 undergraduate full tuition discount partial tuition waiver
22 benefits under this Section.
23     (d) No full tuition discount partial tuition waiver offered
24 or allocated to any eligible applicant in accordance with the
25 provisions of this Section shall be charged against any tuition
26 waiver limitation established by the Illinois Board of Higher
27 Education.
28     (e) The Board of Trustees shall prescribe rules and
29 regulations as are necessary to implement and administer the
30 provisions of this Section.

32     Section 10. The Southern Illinois University Management
33 Act is amended by changing Section 8f as follows:

23 changing Section 5-90 as follows:

28 Illinois, Southern Illinois University, Chicago State

8 necessary to implement and administer the provisions of this
9 Section.

11     Section 20. The Eastern Illinois University Law is amended
12 by changing Section 10-90 as follows:

15     (a) As used in this Section, "Illinois college or
16 university" means any of the following: the University of
17 Illinois, Southern Illinois University, Chicago State
18 University, Eastern Illinois University, Governors State
19 University, Illinois State University, Northeastern Illinois
20 University, Northern Illinois University, and Western Illinois
21 University.
22     (b) Each year the Board of Eastern Illinois University
23 shall offer 100% tuition discounts 50% tuition waivers for
24 undergraduate education at any campus under its governance to
25 the children, spouses, and domestic partners of employees,
26 including retired employees, of an Illinois college or
27 university who have been employed by any one or by more than
28 one Illinois college or university for an aggregate period of
29 at least 7 years. "Domestic partner" means 2 individuals of the

19 university" means any of the following: the University of
20 Illinois, Southern Illinois University, Chicago State

22 University, Illinois State University, Northeastern Illinois
23 University, Northern Illinois University, and Western Illinois
24 University.
25     (b) Each year the Board of Northeastern Illinois University
26 shall offer 100% tuition discounts 50% tuition waivers for
27 undergraduate education at any campus under its governance to
28 the children, spouses, and domestic partners of employees,
29 including retired employees, of an Illinois college or
30 university who have been employed by any one or by more than
31 one Illinois college or university for an aggregate period of
32 at least 7 years. "Domestic partner" means 2 individuals of the

24     (e) The Board shall prescribe rules and regulations as are
25 necessary to implement and administer the provisions of this
26 Section.

28     Section 45. The Western Illinois University Law is amended
29 by changing Section 35-90 as follows:

31     Sec. 35-90. Full tuition discount Partial tuition waivers.
32     (a) As used in this Section, "Illinois college or
33 university" means any of the following: the University of
34 Illinois, Southern Illinois University, Chicago State

1 University, Eastern Illinois University, Governors State
2 University, Illinois State University, Northeastern Illinois
3 University, Northern Illinois University, and Western Illinois
4 University.
5     (b) Each year the Board of Western Illinois University
6 shall offer 100% tuition discounts 50% tuition waivers for
7 undergraduate education at any campus under its governance to
8 the children, spouses, and domestic partners of employees,
9 including retired employees, of an Illinois college or
10 university who have been employed by any one or by more than
11 one Illinois college or university for an aggregate period of
12 at least 7 years. "Domestic partner" means 2 individuals of the
13 same gender who (1) live together in a long-term relationship
14 of indefinite duration; (2) have resided together at the same
15 address for at least 12 months; (3) are not related by blood to
16 a degree of closeness that would prohibit legal marriage in the
17 state in which they legally reside; (4) are not married to any
18 other person; and (5) have an exclusive mutual commitment in
19 which they agree to be jointly responsible for each other's
20 common welfare and to share financial obligations. "Retired
21 employee" means a person receiving a retirement or disability
22 retirement annuity under the Illinois Pension Code based on at
23 least 7 years of service with one or more than one Illinois
24 college or university, including a person who already is
25 receiving such an annuity on the effective date of this
26 amendatory Act of the 94th General Assembly.
27     To be eligible to receive a full tuition discount partial
28 tuition waiver, the person child of an employee of an Illinois
29 college or university (i) if a child, must be under the age of
30 25 at the commencement of the academic year during which the
31 full tuition discount partial tuition waiver is to be
32 effective, and (ii) must qualify for admission to Western
33 Illinois University under the same admissions requirements,
34 standards and policies which Western Illinois University
35 applies to applicants for admission generally to its respective
36 undergraduate colleges and programs.

1     (c) Subject to the provisions and limitations of subsection
2 (b), an eligible applicant who has continued to maintain
3 satisfactory academic progress toward graduation may have his
4 or her full tuition discount partial tuition waiver renewed
5 until the time as he or she has expended 4 years of
6 undergraduate full tuition discount partial tuition waiver
7 benefits under this Section.
8     (d) No full tuition discount partial tuition waiver offered
9 or allocated to any eligible applicant in accordance with the
10 provisions of this Section shall be charged against any tuition
11 waiver limitation established by the Illinois Board of Higher
12 Education.
13     (e) The Board shall prescribe rules and regulations as are
14 necessary to implement and administer the provisions of this
15 Section.

17     Section 99. Effective date. This Act takes effect upon
18 becoming law.
