1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Automated Traffic Control Systems in Highway
5 Construction or Maintenance Zones Act is amended by changing
6 Sections 10 and 30 as follows:
 
7     (625 ILCS 7/10)
8     Sec. 10. Establishment of automated control systems. The
9 Department of State Police may establish an automated traffic
10 control system in any construction or maintenance zone
11 established by the Department of Transportation or the Illinois
12 State Toll Highway Authority. An automated traffic control
13 system may operate only during those periods when workers are
14 present in the construction or maintenance zone. In any
15 prosecution based upon evidence obtained through an automated
16 traffic control system established under this Act, the State
17 must prove that one or more workers were present in the
18 construction or maintenance zone when the violation occurred.

21     Sec. 30. Requirements for issuance of a citation.
22     (a) The vehicle, vehicle operator, vehicle registration
23 plate, speed, date, time, and location must be clearly visible
24 on the photograph or other recorded image of the alleged
25 violation.
26     (b) A Uniform Traffic Citation must be mailed or otherwise
27 delivered to the registered owner of the vehicle. If mailed,
28 the citation must be sent via certified mail within 14 6
29 business days of the alleged violation, return receipt
30 requested.
31     (c) The Uniform Traffic Citation must include:

1         (1) the name and address of the vehicle owner;
2         (2) the registration number of the vehicle;
3         (3) the offense charged;
4         (4) the time, date, and location of the violation;
5         (5) the first available court date; and
6         (6) notice that the basis of the citation is the
7     photograph or recorded image from the automated traffic
8     control system.
9     (d) The Uniform Traffic Citation issued to the violator
10 must be accompanied by a written document that lists the
11 violator's rights and obligations and explains how the violator
12 can elect to proceed by either paying the fine or challenging
13 the issuance of the Uniform Traffic Citation.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
