SYNOPSIS AS INTRODUCED:
 
20 ILCS 3410/20 new

    Amends the Illinois Historic Preservation Act. Creates the Historic Preservation Advisory Council, appointed by the Governor, to assist the Illinois Historic Preservation Agency in protecting and preserving historic sites. Requires the Council to establish priorities and criteria for such protection and preservation and to review and evaluate proposals for grants administered by the Agency.

1     AN ACT concerning historic preservation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Historic Preservation Act is
5 amended by adding Section 20 as follows:
 
6     (20 ILCS 3410/20 new)
7     Sec. 20. Historic Preservation Advisory Council.
8     (a) In order to enhance public participation and
9 involvement in the preservation and protection of the State's
10 historic and archaeological sites and properties, there is
11 created within the Illinois Historic Preservation Agency the
12 Historic Preservation Advisory Council.
13     The Council shall consist of 12 members who represent
14 different areas of the State and who are appointed by the
15 Governor with the advice and consent of the Senate. The Council
16 members must be qualified as follows:
17         (1) At least 5 members shall have practical experience
18     in the preservation of historic or archaeological sites and
19     properties as demonstrated in one or more of the following
20     fields: architecture, architectural history, historic
21     preservation, history, archaeology, or a local historic
22     preservation board, commission, or nonprofit organization.
23     No employee or contractual employee of the Illinois
24     Historic Preservation Agency may serve on the Council.
25         (2) Each of at least 5 members shall be the president,
26     chief elected officer, or other duly authorized
27     representative of a statewide commercial or residential
28     developers association, statewide realtors association, or
29     economic development organization.
30         (3) The remaining 2 members shall be at-large members.
31     (b) Members shall be appointed for 4-year terms, except for
32 an appointment to fill an unexpired term, in which event the

1 appointment shall be for the remainder of the unexpired term
2 only. No person shall serve more than 2 consecutive terms on
3 the Council.
4     (c) Members shall elect a chairperson annually. No member
5 shall be elected to consecutive terms as chairperson.
6     (d) The Council shall meet at least quarterly throughout
7 the State fiscal year. However, the chairperson, a majority of
8 the members, or the Agency may convene the Council. Members
9 shall serve without pay, but shall be entitled to reimbursement
10 for expenses incurred in the performance of their duties. All
11 members of the Council shall be legal residents of the State.
12     (e) All action taken by the Council shall be by majority
13 vote of those present. The Director of the Agency or the
14 Director's designee shall serve without voting rights as
15 secretary to the Council. The Agency shall provide necessary
16 staff assistance to the Council.
17     (f) It shall be the responsibility of the Council to
18 provide assistance, advice, and recommendations to the Agency
19 in:
20         (1) Establishing priorities for the identification,
21     acquisition, protection, and preservation of historic and
22     archaeological sites and properties.
23         (2) Establishing criteria for use in assessing the
24     significance of historic and archaeological sites and
25     properties.
26         (3) Evaluating proposals for awards of historic
27     preservation grants administered by the Agency. The
28     Council shall review and evaluate all proposals for grants
29     and shall make recommendations, including a priority
30     ranking, reflecting such evaluation. In making such
31     evaluation and recommendations, the Council shall, at a
32     minimum, consider the purpose, economic and other public
33     benefit, location, compatibility with statewide historic
34     preservation priorities, and cost of each proposal for
35     grant assistance.
36         (4) Preparing rules relating to the historic

1     preservation programs administered by the Agency.
2     (g) It shall be the additional responsibility of the
3 Council to provide such other assistance and advice to the
4 Agency as may be required from time to time in matters
5 pertaining to the protection and preservation of the State's
6 historic and archaeological sites and properties.
