    Amends the Nursing Home Care Act. Makes a technical change in a Section concerning the nurse aide registry.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by changing
5 Section 3-206.01 as follows:
 
6     (210 ILCS 45/3-206.01)  (from Ch. 111 1/2, par. 4153-206.01)
7     Sec. 3-206.01. Nurse aide registry.
8     (a) The The Department shall establish and maintain a
9 registry of all individuals who have satisfactorily completed
10 the training required by Section 3-206. The registry shall
11 include the name of the nursing assistant, habilitation aide,
12 or child care aide, his or her current address, Social Security
13 number, and the date and location of the training course
14 completed by the individual, and the date of the individual's
15 last criminal records check. Any individual placed on the
16 registry is required to inform the Department of any change of
17 address within 30 days. A facility shall not employ an
18 individual as a nursing assistant, habilitation aide, or child
19 care aide unless the facility has inquired of the Department as
20 to information in the registry concerning the individual and
21 shall not employ anyone not on the registry unless the
22 individual is enrolled in a training program under paragraph
23 (5) of subsection (a) of Section 3-206 of this Act.
24     If the Department finds that a nursing assistant,
25 habilitation aide, or child care aide has abused a resident,
26 neglected a resident, or misappropriated resident property in a
27 facility, the Department shall notify the individual of this
28 finding by certified mail sent to the address contained in the
29 registry. The notice shall give the individual an opportunity
30 to contest the finding in a hearing before the Department or to
31 submit a written response to the findings in lieu of requesting
32 a hearing. If, after a hearing or if the individual does not

1 request a hearing, the Department finds that the individual
2 abused a resident, neglected a resident, or misappropriated
3 resident property in a facility, the finding shall be included
4 as part of the registry as well as a brief statement from the
5 individual, if he or she chooses to make such a statement. The
6 Department shall make information in the registry available to
7 the public. In the case of inquiries to the registry concerning
8 an individual listed in the registry, any information disclosed
9 concerning such a finding shall also include disclosure of any
10 statement in the registry relating to the finding or a clear
11 and accurate summary of the statement.
12     (b) The Department shall add to the nurse aide registry
13 records of findings as reported by the Inspector General or
14 remove from the nurse aide registry records of findings as
15 reported by the Department of Human Services, under Section 6.2
16 of the Abused and Neglected Long Term Care Facility Residents
17 Reporting Act.
