SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.01  from Ch. 111 1/2, par. 1022.01

    Amends the Environmental Protection Act. Provides that manifests for nonhazardous special waste shall consist of forms prescribed by the Environmental Protection Agency. Provides that the forms may include information identical to those manifests required for the shipment of hazardous waste. Repeals a provision requiring the manifest to be identical to those required by the Pollution Control Board. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 22.01 as follows:
 
6    (415 ILCS 5/22.01)  (from Ch. 111 1/2, par. 1022.01)
7    Sec. 22.01. Manifests for nonhazardous special waste. When
8manifests are required by the Board for the shipment of
9nonhazardous special waste, such manifests shall consist of
10forms prescribed by the Agency specifically for such purpose.
11Such forms may include information be identical to manifests
12required for the shipment of hazardous waste. Such manifests
13may be provided by the Agency, and shall be identical to the
14manifests required by the Board for hazardous waste. Generators
15of nonhazardous special waste and facilities accepting
16nonhazardous special waste are not required to submit copies of
17nonhazardous special waste manifests to the Agency; provided,
18however, that generators of nonhazardous special waste
19containing polychlorinated biphenyls and facilities accepting
20nonhazardous special waste containing polychlorinated
21biphenyls shall submit copies of nonhazardous special waste
22manifests to the Agency for shipments of waste containing
23polychlorinated biphenyls. Copies of each manifest shall be

1retained for 3 years by generators and facilities, and shall be
2available for inspection and copying by the Agency. The Agency
3may adopt such procedures for the distribution of copies of
4manifests as it deems necessary. Nothing in this Section shall
5preclude the Agency from collecting fees under Section 22.8 (g)
6of this Act. Generators of nonhazardous special waste shall not
7be required to file reports with the Agency regarding the
8shipment of nonhazardous special waste within the State of
9Illinois; provided, however, that the Board may require
10generators of nonhazardous special waste to file annual reports
11with the Agency regarding the shipment of nonhazardous special
12waste out-of-state. Commencing February 1, 1992, and annually
13thereafter, facilities accepting nonhazardous special waste
14shall file a report with the Agency, specifying the quantities
15and disposition of nonhazardous special waste accepted for
16treatment, storage or disposal during the previous calendar
17year.
18    Nothing in this Section shall be interpreted or construed
19to prohibit any company treating, storing or disposing of
20nonhazardous special wastes from requiring manifests to be
21submitted to it for such wastes. This Section does not apply to
22potentially infectious medical waste.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.
