 1        AN ACT in relation to public aid.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Public Aid Code is amended by
 5    adding Section 5-2.05 as follows:

 6        (305 ILCS 5/5-2.05 new)
 7        Sec. 5-2.05. Disabled children.
 8        (a)  The Department of Public Aid may offer, to  children
 9    with  developmental disabilities and severely mentally ill or
10    emotionally  disturbed  children  who  otherwise  would   not
11    qualify  for  medical  assistance  under  this Article due to
12    family  income,  home-based  and   community-based   services
13    instead   of   institutional   placement,  as  allowed  under
14    paragraph 7 of Section 5-2.
15        (b)  The Department of Public Aid,  in  conjunction  with
16    the   Department  of  Human  Services  and  the  Division  of
17    Specialized    Care    for    Children,     University     of
18    Illinois-Chicago,  shall  also report to the Governor and the
19    General Assembly no later than January 1, 2004 regarding  the
20    status  of  existing  services  offered  under paragraph 7 of
21    Section 5-2. This report shall include, but  not  be  limited
22    to, the following information:
23             (1)  The   number  of  persons  eligible  for  these
24        services.
25             (2)  The number of persons  who  applied  for  these
26        services.
27             (3)  The  number  of  persons  who currently receive
28        these services.
29             (4)  The  nature,  scope,  and  cost   of   services
30        provided under paragraph 7 of Section 5-2.
31             (5)  The   comparative   cost   of  providing  those

 1        services in a  hospital,  skilled  nursing  facility,  or
 2        intermediate care facility.
 3             (6)  The   funding  sources  for  the  provision  of
 4        services, including federal financial participation.
 5             (7)  The qualifications, skills, and availability of
 6        caregivers for children receiving services.
 7        The report shall also include information  regarding  the
 8    extent  to which the existing programs could provide coverage
 9    for  mentally  disabled  children  who  are  currently  being
10    provided services in an institution who  could  otherwise  be
11    served in a less-restrictive, community-based setting for the
12    same or a lower cost.

13        Section  99.  Effective  date. This Act takes effect upon
14    becoming law.
