    Amends the School Code. Requires revenues from vending machines that are not within the school cafeteria to be used exclusively for physical education and nutritional education. Effective September 1, 2004.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.39 and 34-18.30 as follows:
 
6     (105 ILCS 5/10-20.39 new)
7     Sec. 10-20.39. Vending machine revenues. A school board
8 shall require that all school revenues generated from vending
9 machines that are not within the school cafeteria, including
10 revenues from the placement of the machines and from the sale
11 of items in the machines, shall be used exclusively for
12 physical education and nutritional education.
 
13     (105 ILCS 5/34-18.30 new)
14     Sec. 34-18.30. Vending machine revenues. The board shall
15 require that all school revenues generated from vending
16 machines that are not within the school cafeteria, including
17 revenues from the placement of the machines and from the sale
18 of items in the machines, shall be used exclusively for
19 physical education and nutritional education.
 
20     Section 99. Effective date. This Act takes effect September
21 1, 2004.
