SYNOPSIS AS INTRODUCED:
 
225 ILCS 65/5-16 new
225 ILCS 65/20-40

    Amends the Nursing and Advanced Practice Nursing Act. Provides that the Department of Professional Regulation shall create the Illinois Center for Nursing. Provides a list of goals for the Center and requires the Center to work in conjunction with the Illinois Coalition for Nursing Resources in accomplishing its goals. Provides that moneys in the Nursing Dedicated and Professional Fund may be used for the establishment of the Center and provides for the appropriation of money from the Fund to the Department to be used within 2 fiscal years of the effective date for the Center. Effective immediately.

1     AN ACT in relation to nursing.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing and Advanced Practice Nursing Act is
5 amended by changing Section 20-40 and adding Section 5-16 as
6 follows:
 
7     (225 ILCS 65/5-16 new)
8     (Section scheduled to be repealed on January 1, 2008)
9     Sec. 5-16. Illinois Center for Nursing. The Department
10 shall create the Illinois Center for Nursing, the goals of
11 which shall include, but not be limited to, all of the
12 following:
13         (1) To develop and implement a strategic statewide plan
14     to address the nursing workforce needs in Illinois.
15         (2) To evaluate population demographics and available
16     health indicator data to determine how the population needs
17     relate to the demand for nursing services.
18         (3) To create a dynamic system for projecting nurse
19     workforce supply and demand.
20         (4) To support the development of a nursing workforce
21     to include the diversity, educational mix, geographic
22     distribution, and numbers needed within the State.
23         (5) To develop strategies for ensuring adequate
24     numbers of nurse faculty who are prepared to educate
25     students to meet the needs of patients, families, and
26     health care organizations.
27         (6) To monitor educational trends in nursing,
28     including applications, enrollments, and graduate
29     outcomes.
30         (7) To develop collaborative models between nursing
31     education and practice to identify necessary competencies,
32     educational strategies, and models of professional

1     practice.
2         (8) To provide funding for the planning and
3     implementation of demonstration projects of nursing
4     educational models and professional practice models that
5     will address the health care needs within the State of
6     Illinois.
7     The Illinois Center for Nursing shall work in conjunction
8 with the Illinois Coalition for Nursing Resources in
9 accomplishing its goals.

12     Sec. 20-40. Fund. There is hereby created within the State
13 Treasury the Nursing Dedicated and Professional Fund. The
14 monies in the Fund may be used by and at the direction of the
15 Department for the administration and enforcement of this Act,
16 including but not limited to:
17         (a) Distribution and publication of the Nursing and
18     Advanced Practice Nursing Act and the rules at the time of
19     renewal to all persons licensed by the Department under
20     this Act.
21         (b) Employment of secretarial, nursing,
22     administrative, enforcement, and other staff for the
23     administration of this Act.
24         (c) Conducting a survey, as prescribed by rule of the
25     Department, once every 4 years during the license renewal
26     period.
27         (d) Conducting of training seminars for licensees
28     under this Act relating to the obligations,
29     responsibilities, enforcement and other provisions of the
30     Act and its rules.
31         (d-5) Establishment of the Illinois Center for Nursing
32     as provided for in Section 5-16.
33         (e) Disposition of Fees:
34             (i) (Blank).
35             (ii) All of the fees and fines collected pursuant

1         to this Act shall be deposited in the Nursing Dedicated
2         and Professional Fund.
3             (iii) For the fiscal year beginning July 1, 1988,
4         the moneys deposited in the Nursing Dedicated and
5         Professional Fund shall be appropriated to the
6         Department for expenses of the Department and the Board
7         in the administration of this Act. All earnings
8         received from investment of moneys in the Nursing
9         Dedicated and Professional Fund shall be deposited in
10         the Nursing Dedicated and Professional Fund and shall
11         be used for the same purposes as fees deposited in the
12         Fund.
13             (iv) For the fiscal year beginning July 1, 2001 and
14         for each fiscal year thereafter, $750,000 of the moneys
15         deposited in the Nursing Dedicated and Professional
16         Fund each year shall be set aside and appropriated to
17         the Illinois Department of Public Health for nursing
18         scholarships awarded pursuant to the Nursing Education
19         Scholarship Law. Representatives of the Department and
20         the Nursing Education Scholarship Program Advisory
21         Council shall review this requirement and the
22         scholarship awards every 2 years.
23             (iv-5) For the fiscal year beginning July 1, 2004,
24         $1,000,000 of the moneys deposited into the Nursing
25         Dedicated and Professional Fund shall be appropriated
26         to the Department to be used within 2 fiscal years of
27         the effective date of this amendatory Act of the 93rd
28         General Assembly to establish the Illinois Center for
29         Nursing as provided for in Section 5-16 and subsection
30         (d-5) of this Section.
31             (v) Moneys in the Fund may be transferred to the
32         Professions Indirect Cost Fund as authorized under
33         Section 2105-300 of the Department of Professional
34         Regulation Law (20 ILCS 2105/2105-300).

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
