SYNOPSIS AS INTRODUCED:

20 ILCS 2310/2310-610 new

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to classify obesity as a disease. Effective immediately.

A BILL FOR

AN ACT in relation to public health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois is amended by adding Section 2310-610 as follows:

(20 ILCS 2310/2310-610 new)

Sec. 2310-610. Disease classification; obesity. The Department shall classify obesity as a disease.

For the purpose of this Section:

"Body mass index" means a mathematical formula used to determine a person's body weight in relation to height as measured by dividing a person's weight in kilograms by the square of the person's height in meters.

"Obesity" means:

(1) having a body mass index of 30 or greater; or

(2) having a body mass index of 27 or greater and having one or more of the following:

(i) Type II diabetes mellitus;

(ii) Impaired glucose tolerance;

(iii) Hypertension;

(iv) Cardiovascular disease;

(v) Gastric reflux disease;

(vi) Gall bladder disease;

(vii) Osteoarthritis of the hips or knees;

(viii) Sleep apnea;

(ix) Cerebrovascular disease (stroke);

(x) Coronary heart disease;

(xi) Dyslipidemia;

(xii) Gout;

(xiii) Cancer;

(xiv) Infertility; or

(xv) Respiratory difficulties

Section 99. Effective date. This Act takes effect upon becoming law.
