SYNOPSIS AS INTRODUCED:

20 ILCS 2310/2310-338 new

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to establish and maintain a program to accept reports of asthma cases occurring in the State. Requires physicians and certain health care facilities to give notice to the Department of every case of asthma coming under their care. Sets forth the duties of the Department in administering the program. Requires the Department to submit annual reports to the General Assembly concerning the program. Contains other provisions.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois is amended by adding Section 2310-338 as follows:

Sec. 2310-338. Asthma reporting.

(a) The Department shall establish and maintain a program to accept reports of asthma cases occurring in the State.

Every each physician must, within 180 days, give notice to the Department of every case of asthma coming under his or her care.

(b) The person in charge of every asthma reporting facility must, within 180 days, give notice of every case of asthma coming under the care of that facility to the Department.

All abstracting work performed by an asthma reporting facility under the reporting provisions of this Section shall be performed by a certified asthma registrar. Asthma reporting facilities may establish consortia to engage a certified asthma registrar to perform the reporting requirements of this Section. A "certified asthma registrar" is an individual certified by a nationally recognized not-for-profit organization that certifies asthma registrars. The provisions of this subsection do not apply to any asthma reporting facility that renders services for 100 or fewer cases of asthma per year, as determined by the Department.

(c) The Department shall create, and update as necessary, a manual designating which specific data elements must be reported to the Department under this Section. The Department shall make this manual available to every asthma reporting facility and physician required to comply with the provisions of this Section.

The Department shall establish and update as necessary a data dictionary to standardize information interpretation of data elements reported by asthma reporting facilities and other health care providers. The Department must make this dictionary available to every asthma reporting facility and physician required to comply with the provisions of this Section.

The Department shall, subject to appropriation, establish or contract for regional training programs to provide training to any asthma reporting facility or physician required to comply with the provisions of this Section. The regional training programs must provide training relating to the specific data elements that must be reported under this Section, the data dictionary, and any other subjects that are intended to ensure quality, timely, and complete compliance with this Section.

The Department shall meet asthma registry goals established by a nationally recognized central asthma registry organization, unless any such goal is contrary to any provision of law.

If an asthma reporting facility fails to comply with the provisions of this Section, the Department may elect to perform registry services for the facility. The asthma reporting facility must reimburse the Department for actual expenses incurred.

(d) If a physician or asthma reporting facility violates any provision of this Section, the Department must report that violation to the licensing board or State agency that regulates the physician or facility.

(e) The notices required by this Section shall be upon forms supplied by the Department and shall contain such information as shall be required by the Department.

(f) For the purposes of this Section, an "asthma reporting facility" means a hospital, clinic, health maintenance organization, or other similar public or private institution.

(g) The Department may adopt any rules necessary to implement this Section.

(h) The Department must submit an annual report to the General Assembly by December 31 of each year. The report must include: an evaluation of the asthma registry as it relates to timeliness, quality, and completeness; an evaluation of the utility of the registry for scientific research; an evaluation of the access, timeliness, and quality of reporting information to researchers and other similar individuals; an evaluation of the registry's data elements, including treatment, stage of disease, occupation, and residence; an evaluation of the feasibility and utility of inclusion of occupational history and residence history; and an evaluation of integrating the registry with other databases maintained by State agencies and Departments.

The reports of asthma cases made under the provisions of this Section may not be divulged or made public by any person so as to disclose the identity of any person to whom they relate, except as authorized by law.
