SYNOPSIS AS INTRODUCED:

    Amends the Department of Transportation Law of the Civil Administrative Code of Illinois and the School Code. Requires the Department of Transportation, in cooperation with the State Board of Education and the Department of State Police, to establish and administer a Safe Routes to School Construction Program for the construction of bicycle and pedestrian safety and traffic-calming projects using federal transportation funds, with construction grants being made available to local governmental agencies. Provides that a school board may not prohibit students from riding bicycles to or from school. Effective immediately.

1     AN ACT concerning school students.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Transportation Law of the
5 Civil Administrative Code of Illinois is amended by adding
6 Section 2705-580 as follows:
 
7     (20 ILCS 2705/2705-580 new)
8     Sec. 2705-580. Safe Routes to School Construction Program.
9     (a) The Department, in cooperation with the State Board of
10 Education and the Department of State Police, shall establish
11 and administer a Safe Routes to School Construction Program for
12 the construction of bicycle and pedestrian safety and
13 traffic-calming projects using federal transportation funds.
14     (b) The Department shall make construction grants
15 available to local governmental agencies under the Safe Routes
16 to School Construction Program based on the results of a
17 statewide competition that requires submission of Safe Routes
18 to School proposals for funding and that rates those proposals
19 on all of the following factors:
20         (1) Demonstrated needs of the grant applicant.
21         (2) Potential of the proposal for reducing child
22     injuries and fatalities.
23         (3) Potential of the proposal for encouraging
24     increased walking and bicycling among students.
25         (4) Identification of safety hazards.
26         (5) Identification of current and potential walking
27     and bicycling routes to school.
28         (6) Consultation and support for projects by
29     school-based associations, local traffic engineers, local
30     elected officials, law enforcement agencies, and school
31     officials.
32     With respect to the use of federal transportation funds,

1 prior to the award of a construction grant or the use of those
2 funds for a Safe Routes to School project encompassing a
3 freeway, State highway, or county road, the Department shall
4 consult with and obtain approval from the Department of State
5 Police ensuring that the Safe Routes to School proposal is
6 consistent with a statewide pedestrian safety statistical
7 analysis.
8     (c) The State Board of Education, Department of
9 Transportation, and Department of State Police may adopt any
10 rules necessary to implement this Section.

12     Section 10. The School Code is amended by adding Sections
13 10-20.39 and 34-18.30 as follows:
 
14     (105 ILCS 5/10-20.39 new)
15     Sec. 10-20.39. No ban on bicycles. A school board may not
16 prohibit students from riding bicycles to or from school.
 
17     (105 ILCS 5/34-18.30 new)
18     Sec. 34-18.30. No ban on bicycles. The board may not
19 prohibit students from riding bicycles to or from school.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
