 1        AN ACT concerning unemployment insurance.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Unemployment Insurance Act is amended  by
 5    changing Section 1200 as follows:

 6        (820 ILCS 405/1200) (from Ch. 48, par. 530)
 7        Sec. 1200. Compensation of attorneys.
 8        No  fee  shall  be charged any claimant in any proceeding
 9    under this Act by the Director or his representatives, or  by
10    the  Referees  or  Board  of  Review,  or by any court or the
11    clerks thereof except as provided herein.
12        Any individual claiming benefits in any proceeding before
13    the Director or his representative, or  the  Referee  or  the
14    Board  of  Review, or his or its representatives, or a court,
15    may be represented by counsel or other duly authorized agent;
16    but no such counsel or agents shall either charge or  receive
17    for  such  services more than an amount approved by the Board
18    of Review or, in cases arising  under  Section  604,  by  the
19    Director.
20        After   reasonable   notice  and  a  hearing  before  the
21    Department's representative, any  attorney  found  to  be  in
22    violation  of any provision of this Section shall be required
23    to make restitution of any excess fees charged plus  interest
24    at  a  reasonable  rate  as  determined  by  the Department's
25    representative.
26        Any person who shall exact or receive any remuneration or
27    gratuity for any services rendered on behalf of such claimant
28    except as allowed by this Section and in an  amount  approved
29    by  the  Board of Review or the Director, as the case may be,
30    shall be guilty of a Class  A  misdemeanor.  Any  person  who
31    shall  solicit  the  business  of appearing on behalf of such

 1    claimant  or  who  shall  make  it  a  business  to   solicit
 2    employment  for  another  in  connection  with  any claim for
 3    benefits under  this  Act  shall  be  guilty  of  a  Class  A
 4    misdemeanor.
