 1        AN ACT concerning insurance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Insurance  Code is amended by
 5    changing Section 370b as follows:

 6        (215 ILCS 5/370b) (from Ch. 73, par. 982b)
 7        Sec.     370b.  Reimbursement     on     equal     basis.
 8    Notwithstanding any provision  of  any  individual  or  group
 9    policy  of accident and health insurance, or any provision of
10    a policy, contract, plan or agreement for hospital or medical
11    service  or  indemnity,  whenever   wherever   such   policy,
12    contract,  plan  or  agreement provides for reimbursement for
13    any service provided by persons licensed  under  the  Medical
14    Practice Act of 1987 or the Podiatric Medical Practice Act of
15    1987,  the  person  entitled to benefits or person performing
16    services under such policy, contract, plan  or  agreement  is
17    entitled to reimbursement on an equal basis for such service,
18    when  the service is performed by a person licensed under the
19    Medical  Practice  Act  of  1987  or  the  Podiatric  Medical
20    Practice Act of 1987.  The provisions of this Section do  not
21    apply  to  any  policy, contract, plan or agreement in effect
22    prior  to  September  19,  1969  or  to  preferred   provider
23    arrangements or benefit agreements.
