1 AN ACT in relation to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 1-140, 11-302, 11-304, 15-102, 15-107,
6 15-111, and 15-316 as follows:

9 Every county, municipal, and other local board,or body,
10 or road district having authority to enact laws relating to
11 traffic under the constitution and laws of this State.

14 Sec. 11-302. Authority to designate through highway and
15 stop and yield intersections.
16 (a) The Department with reference to State highways
17 under its jurisdiction, and local authorities and road
18 district highway commissioners with reference to other
19 highways under their jurisdiction, may designate through
20 highways and erect stop signs or yield signs at specified
21 entrances thereto, or may designate any intersection as a
22 stop intersection or as a yield intersection and erect stop
23 signs or yield signs at one or more entrances to such
24 intersection. Designation of through highways and stop or
25 yield intersections and the erection of stop signs or yield
26 signs on township or road district roads are subject to the
27 written approval of the county engineer or superintendent of
28 highways.
29 (b) Every stop sign and yield sign shall conform to the
30 State Manual and Specifications and shall be located as near

1 as practicable to the nearest line of the crosswalk on the
2 near side of the intersection or, if there is no crosswalk,
3 then as close as practicable to the nearest line of the
4 intersecting roadway.
5 (c) The Department may in its discretion and when
6 traffic conditions warrant such action give preference to
7 traffic upon any of the State highways under its jurisdiction
8 over traffic crossing or entering such highway by erecting
9 appropriate traffic control devices.

12 Sec. 11-304. Local traffic-control devices; tourist
13 oriented businesses signs.
14 Local authorities and road district highway commissioners
15 in their respective maintenance jurisdiction shall place and
16 maintain such traffic-control devices upon highways under
17 their maintenance jurisdiction as are required to indicate
18 and carry out the provisions of this Chapter, and local
19 traffic ordinances or to regulate, warn, or guide traffic.
20 All such traffic control devices shall conform to the State
21 Manual and Specifications and shall be justified by traffic
22 warrants stated in the Manual. Placement of traffic-control
23 devices on township or road district roads also shall be
24 subject to the written approval of the county engineer or
25 superintendent of highways.
26 Local authorities and road district highway commissioners
27 in their respective maintenance jurisdictions shall have the
28 authority to install signs, in conformance with the State
29 Manual and specifications, alerting motorists of the tourist
30 oriented businesses available on roads under local
31 jurisdiction in rural areas as may be required to guide
32 motorists to the businesses. The local authorities and road
33 district highway commissioners shall also have the authority

1 to sell or lease space on these signs to the owners or
2 operators of the businesses.

5 Sec. 15-102. Width of Vehicles.
6 (a) On Class III and non-designated State and local
7 highways, the total outside width of any vehicle or load
8 thereon shall not exceed 8 feet.
9 (b) Except during those times when, due to insufficient
10 light or unfavorable atmospheric conditions, persons and
11 vehicles on the highway are not clearly discernible at a
12 distance of 1000 feet, the following vehicles may exceed the
13 8 feet limitation during the period from a half hour before
14 sunrise to a half hour after sunset:
15 (1) Loads of hay, straw or other similar farm
16 products provided that the load is not more than 12 feet
17 wide.
18 (2) Implements of husbandry being transported on
19 another vehicle and the transporting vehicle while
20 loaded.
21 The following requirements apply to the
22 transportation on another vehicle of an implement of
23 husbandry wider than 8 feet 6 inches on the National
24 System of Interstate and Defense Highways or other
25 highways in the system of State highways:
26 (A) The driver of a vehicle transporting an
27 implement of husbandry that exceeds 8 feet 6 inches
28 in width shall obey all traffic laws and shall check
29 the roadways prior to making a movement in order to
30 ensure that adequate clearance is available for the
31 movement. It is prima facie evidence that the
32 driver of a vehicle transporting an implement of
33 husbandry has failed to check the roadway prior to

1 making a movement if the vehicle is involved in a
2 collision with a bridge, overpass, fixed structure,
3 or properly placed traffic control device or if the
4 vehicle blocks traffic due to its inability to
5 proceed because of a bridge, overpass, fixed
6 structure, or properly placed traffic control
7 device.
8 (B) Flags shall be displayed so as to wave
9 freely at the extremities of overwidth objects and
10 at the extreme ends of all protrusions, projections,
11 and overhangs. All flags shall be clean, bright red
12 flags with no advertising, wording, emblem, or
13 insignia inscribed upon them and at least 18 inches
14 square.
15 (C) "OVERSIZE LOAD" signs are mandatory on the
16 front and rear of all vehicles with loads over 10
17 feet wide. These signs must have 12-inch high black
18 letters with a 2-inch stroke on a yellow sign that
19 is 7 feet wide by 18 inches high.
20 (D) One civilian escort vehicle is required
21 for a load that exceeds 14 feet 6 inches in width
22 and 2 civilian escort vehicles are required for a
23 load that exceeds 16 feet in width on the National
24 System of Interstate and Defense Highways or other
25 highways in the system of State highways.
26 (E) The requirements for a civilian escort
27 vehicle and driver are as follows:
28 (1) The civilian escort vehicle shall be
29 a passenger car or a second division vehicle
30 not exceeding a gross vehicle weight of 8,000
31 pounds that is designed to afford clear and
32 unobstructed vision to both front and rear.
33 (2) The escort vehicle driver must be
34 properly licensed to operate the vehicle.

1 (3) While in use, the escort vehicle must
2 be equipped with illuminated rotating,
3 oscillating, or flashing amber lights or
4 flashing amber strobe lights mounted on top
5 that are of sufficient intensity to be visible
6 at 500 feet in normal sunlight.
7 (4) "OVERSIZE LOAD" signs are mandatory
8 on all escort vehicles. The sign on an escort
9 vehicle shall have 8-inch high black letters on
10 a yellow sign that is 5 feet wide by 12 inches
11 high.
12 (5) When only one escort vehicle is
13 required and it is operating on a two-lane
14 highway, the escort vehicle shall travel
15 approximately 300 feet ahead of the load. The
16 rotating, oscillating, or flashing lights or
17 flashing amber strobe lights and an "OVERSIZE
18 LOAD" sign shall be displayed on the escort
19 vehicle and shall be visible from the front.
20 When only one escort vehicle is required and it
21 is operating on a multilane divided highway,
22 the escort vehicle shall travel approximately
23 300 feet behind the load and the sign and
24 lights shall be visible from the rear.
25 (6) When 2 escort vehicles are required,
26 one escort shall travel approximately 300 feet
27 ahead of the load and the second escort shall
28 travel approximately 300 feet behind the load.
29 The rotating, oscillating, or flashing lights
30 or flashing amber strobe lights and an
31 "OVERSIZE LOAD" sign shall be displayed on the
32 escort vehicles and shall be visible from the
33 front on the lead escort and from the rear on
34 the trailing escort.

1 (7) When traveling within the corporate
2 limits of a municipality, the escort vehicle
3 shall maintain a reasonable and proper distance
4 from the oversize load, consistent with
5 existing traffic conditions.
6 (8) A separate escort shall be provided
7 for each load hauled.
8 (9) The driver of an escort vehicle shall
9 obey all traffic laws.
10 (10) The escort vehicle must be in safe
11 operational condition.
12 (11) The driver of the escort vehicle
13 must be in radio contact with the driver of the
14 vehicle carrying the oversize load.
15 (F) A transport vehicle while under load of
16 more than 8 feet 6 inches in width must be equipped
17 with an illuminated rotating, oscillating, or
18 flashing amber light or lights or a flashing amber
19 strobe light or lights mounted on the top of the cab
20 that are of sufficient intensity to be visible at
21 500 feet in normal sunlight. If the load on the
22 transport vehicle blocks the visibility of the amber
23 lighting from the rear of the vehicle, the vehicle
24 must also be equipped with an illuminated rotating,
25 oscillating, or flashing amber light or lights or a
26 flashing amber strobe light or lights mounted on the
27 rear of the load that are of sufficient intensity to
28 be visible at 500 feet in normal sunlight.
29 (G) When a flashing amber light is required on
30 the transport vehicle under load and it is operating
31 on a two-lane highway, the transport vehicle shall
32 display to the rear at least one rotating,
33 oscillating, or flashing light or a flashing amber
34 strobe light and an "OVERSIZE LOAD" sign. When a

1 flashing amber light is required on the transport
2 vehicle under load and it is operating on a
3 multilane divided highway, the sign and light shall
4 be visible from the rear.
5 (H) Maximum speed shall be 45 miles per hour
6 on all such moves or 5 miles per hour above the
7 posted minimum speed limit, whichever is greater,
8 but the vehicle shall not at any time exceed the
9 posted maximum speed limit.
10 (3) Portable buildings designed and used for
11 agricultural and livestock raising operations that are
12 not more than 14 feet wide and with not more than a 1
13 foot overhang along the left side of the hauling vehicle.
14 However, the buildings shall not be transported more than
15 10 miles and not on any route that is part of the
16 National System of Interstate and Defense Highways.
17 All buildings when being transported shall display at
18 least 2 red cloth flags, not less than 12 inches square,
19 mounted as high as practicable on the left and right side of
20 the building.
21 A State Police escort shall be required if it is
22 necessary for this load to use part of the left lane when
23 crossing any 2 laned State highway bridge.
24 (c) Vehicles propelled by electric power obtained from
25 overhead trolley wires operated wholly within the corporate
26 limits of a municipality are also exempt from the width
27 limitation.
28 (d) Exemptions are also granted to vehicles designed for
29 the carrying of more than 10 persons under the following
30 conditions:
31 (1) (Blank);
32 (2) When operated within any public transportation
33 service with the approval of local authorities or an
34 appropriate public body authorized by law to provide

1 public transportation. Any vehicle so operated may be 8
2 feet 6 inches in width; or
3 (3) When a county engineer or superintendent of
4 highways, after giving due consideration to the mass
5 transportation needs of the area and to the width and
6 condition of the road, has determined that the operation
7 of buses wider than 8 feet will not pose an undue safety
8 hazard on a particular county or township road segment,
9 he or she may authorize buses not to exceed 8 feet 6
10 inches in width on any highway under that engineer's or
11 superintendent's jurisdiction.
12 (e) A vehicle and load traveling upon the National
13 System of Interstate and Defense Highways or any other
14 highway in the system of State highways that has been
15 designated as a Class I or Class II highway by the
16 Department, or any street or highway designated by local
17 authorities or road district commissioners, may have a total
18 outside width of 8 feet 6 inches, provided that certain
19 safety devices that the Department determines as necessary
20 for the safe and efficient operation of motor vehicles shall
21 not be included in the calculation of width.
22 (e-1) A vehicle and load more than 8 feet wide but not
23 exceeding 8 feet 6 inches in width is allowed access
24 according to the following:
25 (1) A vehicle and load not exceeding 73,280 pounds
26 in weight is allowed access from any State designated
27 highway onto any county, township, or municipal highway
28 for a distance of 5 highway miles for the purpose of
29 loading and unloading, provided:
30 (A) The vehicle and load does not exceed 65
31 feet overall length.
32 (B) There is no sign prohibiting that access.
33 (C) The route is not being used as a
34 thoroughfare between State designated highways.

1 (2) A vehicle and load not exceeding 73,280 pounds
2 in weight is allowed access from any State designated
3 highway onto any county or township highway for a
4 distance of 5 highway miles or onto any municipal highway
5 for a distance of one highway mile for the purpose of
6 food, fuel, repairs, and rest, provided:
7 (A) The vehicle and load does not exceed 65
8 feet overall length.
9 (B) There is no sign prohibiting that access.
10 (C) The route is not being used as a
11 thoroughfare between State designated highways.
12 (3) A vehicle and load not exceeding 80,000 pounds
13 in weight is allowed access from a Class I highway onto
14 any street or highway for a distance of one highway mile
15 for the purpose of loading, unloading, food, fuel,
16 repairs, and rest, provided there is no sign prohibiting
17 that access.
18 (4) A vehicle and load not exceeding 80,000 pounds
19 in weight is allowed access from a Class I or Class II
20 highway onto any State highway or any locally designated
21 highway for a distance of 5 highway miles for the purpose
22 of loading, unloading, food, fuel, repairs, and rest.
23 (5) A trailer or semi-trailer not exceeding 28 feet
24 6 inches in length, that was originally in combination
25 with a truck tractor, shall have unlimited access to
26 points of loading and unloading.
27 (6) All household goods carriers shall have
28 unlimited access to points of loading and unloading.
29 Section 5-35 of the Illinois Administrative Procedure Act
30 relating to procedures for rulemaking shall not apply to the
31 designation of highways under this paragraph (e).
32 (f) Mirrors required by Section 12-502 of this Code and
33 other safety devices identified by the Department may project
34 up to 14 inches beyond each side of a bus and up to 6 inches

1 beyond each side of any other vehicle, and that projection
2 shall not be deemed a violation of the width restrictions of
3 this Section.
4 (g) Any person who is convicted of violating this
5 Section is subject to the penalty as provided in paragraph
6 (b) of Section 15-113.

9 Sec. 15-107. Length of vehicles.
10 (a) The maximum length of a single vehicle on any
11 highway of this State may not exceed 42 feet except the
12 following:
13 (1) Semitrailers.
14 (2) Charter or regulated route buses may be up to
15 45 feet in length, not including energy absorbing
16 bumpers.
17 (a-1) A motor home as defined in Section 1-145.01 may be
18 up to 45 feet in length, not including energy absorbing
19 bumpers. The length limitations described in this subsection
20 (a-1) shall be exclusive of energy-absorbing bumpers and rear
21 view mirrors.
22 (b) On all non-State highways, the maximum length of
23 vehicles in combinations is as follows:
24 (1) A truck tractor in combination with a
25 semitrailer may not exceed 55 feet overall dimension.
26 (2) A truck tractor-semitrailer-trailer may not
27 exceed 60 feet overall dimension.
28 (3) Combinations specially designed to transport
29 motor vehicles or boats may not exceed 60 feet overall
30 dimension.
31 Vehicles operating during daylight hours when
32 transporting poles, pipes, machinery, or other objects of a
33 structural nature that cannot readily be dismembered are

1 exempt from length limitations, provided that no object may
2 exceed 80 feet in length and the overall dimension of the
3 vehicle including the load may not exceed 100 feet. This
4 exemption does not apply to operation on a Saturday, Sunday,
5 or legal holiday. Legal holidays referred to in this Section
6 are the days on which the following traditional holidays are
7 celebrated: New Year's Day; Memorial Day; Independence Day;
8 Labor Day; Thanksgiving Day; and Christmas Day.
9 Vehicles and loads operated by a public utility while en
10 route to make emergency repairs to public service facilities
11 or properties are exempt from length limitations, provided
12 that during night operations every vehicle and its load must
13 be equipped with a sufficient number of clearance lamps on
14 both sides and marker lamps on the extreme ends of any
15 projecting load to clearly mark the dimensions of the load.
16 A tow truck in combination with a disabled vehicle or
17 combination of disabled vehicles, as provided in paragraph
18 (6) of subsection (c) of this Section, is exempt from length
19 limitations.
20 All other combinations not listed in this subsection (b)
21 may not exceed 60 feet overall dimension.
22 (c) Combinations of vehicles may not exceed a total of 2
23 vehicles except the following:
24 (1) A truck tractor semitrailer may draw one
25 trailer.
26 (2) A truck tractor semitrailer may draw one
27 converter dolly.
28 (3) A truck tractor semitrailer may draw one
29 vehicle that is defined in Chapter 1 as special mobile
30 equipment, provided the overall dimension does not exceed
31 60 feet.
32 (4) A truck in transit may draw 3 trucks in transit
33 coupled together by the triple saddlemount method.
34 (5) Recreational vehicles consisting of 3 vehicles,

1 provided the following:
2 (A) The total overall dimension does not
3 exceed 60 feet.
4 (B) The towing vehicle is a properly
5 registered vehicle capable of towing another vehicle
6 using a fifth-wheel type assembly.
7 (C) The second vehicle in the combination of
8 vehicles is a recreational vehicle that is towed by
9 a fifth-wheel assembly. This vehicle must be
10 properly registered and must be equipped with
11 brakes, regardless of weight.
12 (D) The third vehicle must be the lightest of
13 the 3 vehicles and be a trailer or semitrailer
14 designed or used for transporting a boat,
15 all-terrain vehicle, personal watercraft, or
16 motorcycle.
17 (E) The towed vehicles may be only for the use
18 of the operator of the towing vehicle.
19 (F) All vehicles must be properly equipped
20 with operating brakes and safety equipment required
21 by this Code, except the additional brake
22 requirement in subdivision (C) of this subparagraph
23 (5).
24 (6) A tow truck in combination with a disabled
25 vehicle or combination of disabled vehicles, provided the
26 towing vehicle:
27 (A) Is specifically designed as a tow truck
28 having a gross vehicle weight rating of at least
29 18,000 pounds and equipped with air brakes, provided
30 that air brakes are required only if the towing
31 vehicle is towing a vehicle, semitrailer, or
32 tractor-trailer combination that is equipped with
33 air brakes. For the purpose of this subsection,
34 gross vehicle weight rating, or GVWR, means the

1 value specified by the manufacturer as the loaded
2 weight of the tow truck.
3 (B) Is equipped with flashing, rotating, or
4 oscillating amber lights, visible for at least 500
5 feet in all directions.
6 (C) Is capable of utilizing the lighting and
7 braking systems of the disabled vehicle or
8 combination of vehicles.
9 (D) Does not engage a tow exceeding 50 highway
10 miles from the initial point of wreck or disablement
11 to a place of repair. Any additional movement of the
12 vehicles may occur only upon issuance of
13 authorization for that movement under the provisions
14 of Sections 15-301 through 15-319 of this Code.
15 The Department may by rule or regulation prescribe
16 additional requirements regarding length limitations for a
17 tow truck towing another vehicle.
18 For purposes of this Section, a tow-dolly that merely
19 serves as substitute wheels for another legally licensed
20 vehicle is considered part of the licensed vehicle and not a
21 separate vehicle.
22 (d) On Class I highways there are no overall length
23 limitations on motor vehicles operating in combinations
24 provided:
25 (1) The length of a semitrailer, unladen or with
26 load, in combination with a truck tractor may not exceed
27 53 feet.
28 (2) The distance between the kingpin and the center
29 of the rear axle of a semitrailer longer than 48 feet, in
30 combination with a truck tractor, may not exceed 45 feet
31 6 inches.
32 (3) The length of a semitrailer or trailer, unladen
33 or with load, operated in a truck
34 tractor-semitrailer-trailer combination, may not exceed

1 28 feet 6 inches.
2 (4) Maxi-cube combinations, as defined in Chapter
3 1, may not exceed 65 feet overall dimension.
4 (5) Combinations of vehicles specifically designed
5 to transport motor vehicles or boats may not exceed 65
6 feet overall dimension. The length limitation is
7 inclusive of front and rear bumpers but exclusive of the
8 overhang of the transported vehicles, as provided in
9 paragraph (i) of this Section.
10 (6) Stinger steered semitrailer vehicles as defined
11 in Chapter 1, specifically designed to transport motor
12 vehicles or boats, may not exceed 75 feet overall
13 dimension. The length limitation is inclusive of front
14 and rear bumpers but exclusive of the overhang of the
15 transported vehicles, as provided in paragraph (i) of
16 this Section.
17 (7) A truck in transit transporting 3 trucks
18 coupled together by the triple saddlemount method may not
19 exceed 75 feet overall dimension.
20 Vehicles operating during daylight hours when
21 transporting poles, pipes, machinery, or other objects of a
22 structural nature that cannot readily be dismembered are
23 exempt from length limitations, provided that no object may
24 exceed 80 feet in length and the overall dimension of the
25 vehicle including the load may not exceed 100 feet. This
26 exemption does not apply to operation on a Saturday, Sunday,
27 or legal holiday. Legal holidays referred to in this Section
28 are the days on which the following traditional holidays are

9 shall be exclusive of safety and energy conservation devices,
10 such as bumpers, refrigeration units or air compressors and
11 other devices, that the Department may interpret as necessary
12 for safe and efficient operation; except that no device
13 excluded under this paragraph shall have by its design or use
14 the capability to carry cargo.
15 Section 5-35 of the Illinois Administrative Procedure Act
16 relating to procedures for rulemaking shall not apply to the
17 designation of highways under this paragraph (d).
18 (e) On Class II highways there are no overall length
19 limitations on motor vehicles operating in combinations,
20 provided:
21 (1) The length of a semitrailer, unladen or with
22 load, in combination with a truck tractor, may not exceed
23 53 feet overall dimension.
24 (2) The distance between the kingpin and the center
25 of the rear axle of a semitrailer longer than 48 feet, in
26 combination with a truck tractor, may not exceed 45 feet

1 (5) Maxi-cube combinations, as defined in Chapter
2 1, may not exceed 65 feet overall dimension.
3 (6) A combination of vehicles, specifically
4 designed to transport motor vehicles or boats, may not
5 exceed 65 feet overall dimension. The length limitation
6 is inclusive of front and rear bumpers but exclusive of
7 the overhang of the transported vehicles, as provided in
8 paragraph (i) of this Section.
9 (7) Stinger steered semitrailer vehicles, as
10 defined in Chapter 1, specifically designed to transport
11 motor vehicles or boats, may not exceed 75 feet overall
12 dimension. The length limitation is inclusive of front
13 and rear bumpers but exclusive of the overhang of the
14 transported vehicles, as provided in paragraph (i) of
15 this Section.
16 (8) A truck in transit transporting 3 trucks
17 coupled together by the triple saddlemount method may not
18 exceed 75 feet overall dimension.
19 Vehicles operating during daylight hours when
20 transporting poles, pipes, machinery, or other objects of a
21 structural nature that cannot readily be dismembered are

24 vehicle including the load may not exceed 100 feet. This
25 exemption does not apply to operation on a Saturday, Sunday,
26 or legal holiday. Legal holidays referred to in this Section
27 are the days on which the following traditional holidays are
28 celebrated: New Year's Day; Memorial Day; Independence Day;
29 Labor Day; Thanksgiving Day; and Christmas Day.
30 Vehicles and loads operated by a public utility while en
31 route to make emergency repairs to public service facilities
32 or properties are exempt from length limitations, provided
33 that during night operations every vehicle and its load must
34 be equipped with a sufficient number of clearance lamps on

1 both sides and marker lamps on the extreme ends of any
2 projecting load to clearly mark the dimensions of the load.
3 A tow truck in combination with a disabled vehicle or
4 combination of disabled vehicles, as provided in paragraph
5 (6) of subsection (c) of this Section, is exempt from length
6 limitations.
7 Local authorities and road district commissioners, with
8 respect to streets and highways under their jurisdiction, may
9 also by ordinance or resolution allow length limitations of
10 this subsection (e).
11 The length limitations described in this paragraph (e)
12 shall be exclusive of safety and energy conservation devices,
13 such as bumpers, refrigeration units or air compressors and
14 other devices, that the Department may interpret as necessary
15 for safe and efficient operation; except that no device
16 excluded under this paragraph shall have by its design or use
17 the capability to carry cargo.
18 (e-1) Combinations of vehicles not exceeding 65 feet
19 overall length are allowed access as follows:
20 (1) From any State designated highway onto any
21 county, township, or municipal highway for a distance of
22 5 highway miles for the purpose of loading and unloading,
23 provided:
24 (A) The vehicle does not exceed 73,280 pounds
25 in gross weight and 8 feet 6 inches in width.
26 (B) There is no sign prohibiting that access.
27 (C) The route is not being used as a
28 thoroughfare between State designated highways.
29 (2) From any State designated highway onto any
30 county or township highway for a distance of 5 highway
31 miles or onto any municipal highway for a distance of one
32 highway mile for the purpose of food, fuel, repairs, and
33 rest, provided:
34 (A) The vehicle does not exceed 73,280 pounds

1 in gross weight and 8 feet 6 inches in width.
2 (B) There is no sign prohibiting that access.
3 (C) The route is not being used as a
4 thoroughfare between State designated highways.
5 (e-2) Except as provided in subsection (e-3),
6 combinations of vehicles over 65 feet in length, with no
7 overall length limitation except as provided in subsections
8 (d) and (e) of this Section, are allowed access as follows:
9 (1) From a Class I highway onto any street or
10 highway for a distance of one highway mile for the
11 purpose of loading, unloading, food, fuel, repairs, and
12 rest, provided there is no sign prohibiting that access.
13 (2) From a Class I or Class II highway onto any
14 State highway or any locally designated highway for a
15 distance of 5 highway miles for the purpose of loading,
16 unloading, food, fuel, repairs, and rest.
17 (e-3) Combinations of vehicles over 65 feet in length
18 operated by household goods carriers, with no overall length
19 limitations except as provided in subsections (d) and (e) of
20 this Section, have unlimited access to points of loading and
21 unloading.
22 Section 5-35 of the Illinois Administrative Procedure Act
23 relating to procedures for rulemaking shall not apply to the
24 designation of highways under this paragraph (e).
25 (f) On Class III and other non-designated State
26 highways, the length limitations for vehicles in combination
27 are as follows:
28 (1) Truck tractor-semitrailer combinations, must
29 comply with either a maximum 55 feet overall wheel base
30 or a maximum 65 feet extreme overall dimension.
31 (2) Semitrailers, unladen or with load, may not
32 exceed 53 feet overall dimension.
33 (3) No truck tractor-semitrailer-trailer
34 combination may exceed 60 feet extreme overall dimension.

1 (4) The distance between the kingpin and the center
2 axle of a semitrailer longer than 48 feet, in combination
3 with a truck tractor, may not exceed 42 feet 6 inches.
4 (g) Length limitations in the preceding subsections of
5 this Section 15-107 do not apply to the following:
6 (1) Vehicles operated in the daytime, except on
7 Saturdays, Sundays, or legal holidays, when transporting
8 poles, pipe, machinery, or other objects of a structural
9 nature that cannot readily be dismembered, provided the
10 overall length of vehicle and load may not exceed 100
11 feet and no object exceeding 80 feet in length may be
12 transported unless a permit has been obtained as
13 authorized in Section 15-301.
14 (2) Vehicles and loads operated by a public utility
15 while en route to make emergency repairs to public
16 service facilities or properties, but during night
17 operation every vehicle and its load must be equipped
18 with a sufficient number of clearance lamps on both sides
19 and marker lamps upon the extreme ends of any projecting
20 load to clearly mark the dimensions of the load.
21 (3) A tow truck in combination with a disabled
22 vehicle or combination of disabled vehicles, provided the
23 towing vehicle meets the following conditions:
24 (A) It is specifically designed as a tow truck
25 having a gross vehicle weight rating of at least
26 18,000 pounds and equipped with air brakes, provided
27 that air brakes are required only if the towing
28 vehicle is towing a vehicle, semitrailer, or
29 tractor-trailer combination that is equipped with
30 air brakes.
31 (B) It is equipped with flashing, rotating, or
32 oscillating amber lights, visible for at least 500
33 feet in all directions.
34 (C) It is capable of utilizing the lighting

1 and braking systems of the disabled vehicle or
2 combination of vehicles.
3 (D) It does not engage in a tow exceeding 50
4 miles from the initial point of wreck or
5 disablement.
6 The Department may by rule or regulation prescribe
7 additional requirements regarding length limitations for a
8 tow truck towing another vehicle.
9 For the purpose of this subsection, gross vehicle weight
10 rating, or GVWR, shall mean the value specified by the
11 manufacturer as the loaded weight of the tow truck. Legal
12 holidays referred to in this Section shall be specified as
13 the day on which the following traditional holidays are
14 celebrated:
15 New Year's Day;
16 Memorial Day;
17 Independence Day;
18 Labor Day;
19 Thanksgiving Day; and
20 Christmas Day.
21 (h) The load upon any vehicle operated alone, or the
22 load upon the front vehicle of a combination of vehicles,
23 shall not extend more than 3 feet beyond the front wheels of
24 the vehicle or the front bumper of the vehicle if it is
25 equipped with a front bumper. The provisions of this
26 subsection (h) shall not apply to any vehicle or combination
27 of vehicles specifically designed for the collection and
28 transportation of waste, garbage, or recyclable materials
29 during the vehicle's operation in the course of collecting
30 garbage, waste, or recyclable materials if the vehicle is
31 traveling at a speed not in excess of 15 miles per hour
32 during the vehicle's operation and in the course of
33 collecting garbage, waste, or recyclable materials. However,
34 in no instance shall the load extend more than 7 feet beyond

1 the front wheels of the vehicle or the front bumper of the
2 vehicle if it is equipped with a front bumper.
3 (i) The load upon the front vehicle of a combination of
4 vehicles specifically designed to transport motor vehicles
5 shall not extend more than 3 feet beyond the foremost part of
6 the transporting vehicle and the load upon the rear
7 transporting vehicle shall not extend more than 4 feet beyond
8 the rear of the bed or body of the vehicle. This paragraph
9 shall only be applicable upon highways designated in
10 paragraphs (d) and (e) of this Section.
11 (j) Articulated vehicles comprised of 2 sections,
12 neither of which exceeds a length of 42 feet, designed for
13 the carrying of more than 10 persons, may be up to 60 feet in
14 length, not including energy absorbing bumpers, provided that
15 the vehicles are:
16 1. operated by or for any public body or motor
17 carrier authorized by law to provide public
18 transportation services; or
19 2. operated in local public transportation service
20 by any other person and the municipality in which the
21 service is to be provided approved the operation of the
22 vehicle.

24 (k) Any person who is convicted of violating this
25 Section is subject to the penalty as provided in paragraph
26 (b) of Section 15-113.

32 (a) On non-designated highways, no vehicle or
33 combination of vehicles equipped with pneumatic tires may be

1 operated, unladen or with load, when the total weight
2 transmitted to the road surface exceeds 18,000 pounds on a
3 single axle or 32,000 pounds on a tandem axle with no axle
4 within the tandem exceeding 18,000 pounds except:
5 (1) when a different limit is established and
6 posted in accordance with Section 15-316 of this Code;
7 (2) vehicles for which the Department of
8 Transportation and local authorities issue overweight
9 permits under authority of Section 15-301 of this Code;
10 (3) tow trucks subject to the conditions provided
11 in subsection (d) may not exceed 24,000 pounds on a
12 single rear axle or 44,000 pounds on a tandem rear axle;
13 (4) any single axle of a 2-axle truck weighing
14 36,000 pounds or less and not a part of a combination of
15 vehicles, shall not exceed 20,000 pounds;
16 (5) any single axle of a 2-axle truck equipped with
17 a personnel lift or digger derrick, weighing 36,000
18 pounds or less, owned and operated by a public utility,
19 shall not exceed 20,000 pounds;
20 (6) any single axle of a 2-axle truck specially
21 equipped with a front loading compactor used exclusively
22 for garbage, refuse, or recycling may not exceed 20,000
23 pounds per axle, provided that the gross weight of the
24 vehicle does not exceed 40,000 pounds;
25 (7) a truck, not in combination and specially
26 equipped with a selfcompactor or an industrial roll-off
27 hoist and roll-off container, used exclusively for
28 garbage or refuse operations may, when laden, transmit
29 upon the road surface the following maximum weights:
30 22,000 pounds on a single axle; 40,000 pounds on a tandem
31 axle;
32 (8) a truck, not in combination and used
33 exclusively for the collection of rendering materials,
34 may, when laden, transmit upon the road surface the

1 following maximum weights: 22,000 pounds on a single
2 axle; 40,000 pounds on a tandem axle;
3 (9) tandem axles on a 3-axle truck registered as a
4 Special Hauling Vehicle, manufactured prior to or in the
5 model year of 2004 and first registered in Illinois prior
6 to January 1, 2005, with a distance greater than 72
7 inches but not more than 96 inches between any series of
8 2 axles, is allowed a combined weight on the series not
9 to exceed 36,000 pounds and neither axle of the series
10 may exceed 18,000 pounds. Any vehicle of this type
11 manufactured after the model year of 2004 or first
12 registered in Illinois after December 31, 2004 may not
13 exceed a combined weight of 32,000 pounds through the
14 series of 2 axles and neither axle of the series may
15 exceed 18,000 pounds;
16 (10) tandem axles on a 4-axle truck mixer, whose
17 fourth axle is a road surface engaging mixer trailing
18 axle, registered as a Special Hauling Vehicle, used
19 exclusively for the mixing and transportation of concrete
20 and manufactured prior to or in the model year of 2004
21 and first registered in Illinois prior to January 1,
22 2005, with a distance greater than 72 inches but not more
23 than 96 inches between any series of 2 axles, is allowed
24 a combined weight on the series not to exceed 36,000
25 pounds and neither axle of the series may exceed 18,000
26 pounds. Any vehicle of this type manufactured after the
27 model year of 2004 or first registered in Illinois after
28 December 31, 2004 may not exceed a combined weight of
29 32,000 pounds through the series of 2 axles and neither
30 axle of the series may exceed 18,000 pounds;
31 (11) 4-axle vehicles or a 5 or more axle
32 combination of vehicles: The weight transmitted upon the
33 road surface through any series of 3 axles whose centers
34 are more than 96 inches apart, measured between extreme

1 axles in the series, may not exceed those allowed in the
2 table contained in subsection (f) of this Section. No
3 axle or tandem axle of the series may exceed the maximum
4 weight permitted under this Section for a single or
5 tandem axle.
6 No vehicle or combination of vehicles equipped with other
7 than pneumatic tires may be operated, unladen or with load,
8 upon the highways of this State when the gross weight on the
9 road surface through any wheel exceeds 800 pounds per inch
10 width of tire tread or when the gross weight on the road
11 surface through any axle exceeds 16,000 pounds.
12 (b) On non-designated highways, the gross weight of
13 vehicles and combination of vehicles including the weight of
14 the vehicle or combination and its maximum load shall be
15 subject to the foregoing limitations and further shall not
16 exceed the following gross weights dependent upon the number
17 of axles and distance between extreme axles of the vehicle or
18 combination measured longitudinally to the nearest foot.

12 (c) Cities having a population of more than 50,000 may
13 permit by ordinance axle loads on 2 axle motor vehicles 33
14 1/2% above those provided for herein, but the increase shall
15 not become effective until the city has officially notified
16 the Department of the passage of the ordinance and shall not
17 apply to those vehicles when outside of the limits of the
18 city, nor shall the gross weight of any 2 axle motor vehicle
19 operating over any street of the city exceed 40,000 pounds.
20 (d) Weight limitations shall not apply to vehicles
21 (including loads) operated by a public utility when
22 transporting equipment required for emergency repair of
23 public utility facilities or properties or water wells.
24 A combination of vehicles, including a tow truck and a
25 disabled vehicle or disabled combination of vehicles, that
26 exceeds the weight restriction imposed by this Code, may be
27 operated on a public highway in this State provided that
28 neither the disabled vehicle nor any vehicle being towed nor
29 the tow truck itself shall exceed the weight limitations
30 permitted under this Chapter. During the towing operation,
31 neither the tow truck nor the vehicle combination shall
32 exceed 24,000 pounds on a single rear axle and 44,000 pounds
33 on a tandem rear axle, provided the towing vehicle:

1 (1) is specifically designed as a tow truck having
2 a gross vehicle weight rating of at least 18,000 pounds
3 and is equipped with air brakes, provided that air brakes
4 are required only if the towing vehicle is towing a
5 vehicle, semitrailer, or tractor-trailer combination that
6 is equipped with air brakes;
7 (2) is equipped with flashing, rotating, or
8 oscillating amber lights, visible for at least 500 feet
9 in all directions;
10 (3) is capable of utilizing the lighting and
11 braking systems of the disabled vehicle or combination of
12 vehicles; and
13 (4) does not engage in a tow exceeding 20 miles
14 from the initial point of wreck or disablement. Any
15 additional movement of the vehicles may occur only upon
16 issuance of authorization for that movement under the
17 provisions of Sections 15-301 through 15-319 of this
18 Code.
19 Gross weight limits shall not apply to the combination of
20 the tow truck and vehicles being towed. The tow truck
21 license plate must cover the operating empty weight of the
22 tow truck only. The weight of each vehicle being towed shall
23 be covered by a valid license plate issued to the owner or
24 operator of the vehicle being towed and displayed on that
25 vehicle. If no valid plate issued to the owner or operator of
26 that vehicle is displayed on that vehicle, or the plate
27 displayed on that vehicle does not cover the weight of the
28 vehicle, the weight of the vehicle shall be covered by the
29 third tow truck plate issued to the owner or operator of the
30 tow truck and temporarily affixed to the vehicle being towed.
31 The Department may by rule or regulation prescribe
32 additional requirements. However, nothing in this Code shall
33 prohibit a tow truck under instructions of a police officer
34 from legally clearing a disabled vehicle, that may be in

1 violation of weight limitations of this Chapter, from the
2 roadway to the berm or shoulder of the highway. If in the
3 opinion of the police officer that location is unsafe, the
4 officer is authorized to have the disabled vehicle towed to
5 the nearest place of safety.
6 For the purpose of this subsection, gross vehicle weight
7 rating, or GVWR, shall mean the value specified by the
8 manufacturer as the loaded weight of the tow truck.
9 (e) No vehicle or combination of vehicles equipped with
10 pneumatic tires shall be operated, unladen or with load, upon
11 the highways of this State in violation of the provisions of
12 any permit issued under the provisions of Sections 15-301
13 through 15-319 of this Chapter.
14 (f) On designated Class I, II, or III highways and the
15 National System of Interstate and Defense Highways, no
16 vehicle or combination of vehicles with pneumatic tires may
17 be operated, unladen or with load, when the total weight on
18 the road surface exceeds the following: 20,000 pounds on a
19 single axle; 34,000 pounds on a tandem axle with no axle
20 within the tandem exceeding 20,000 pounds; 80,000 pounds
21 gross weight for vehicle combinations of 5 or more axles; or
22 a total weight on a group of 2 or more consecutive axles in
23 excess of that weight produced by the application of the
24 following formula: W = 500 times the sum of (LN divided by
25 N-1) + 12N + 36, where "W" equals overall total weight on any
26 group of 2 or more consecutive axles to the nearest 500
27 pounds, "L" equals the distance measured to the nearest foot
28 between extremes of any group of 2 or more consecutive axles,
29 and "N" equals the number of axles in the group under
30 consideration.

5 Local authorities and road district highway
6 commissioners, with respect to streets and highways under
7 their jurisdiction, without additional fees, may also by
8 ordinance or resolution allow the weight limitations of this
9 subsection, provided the maximum gross weight on any one axle
10 shall not exceed 20,000 pounds and the maximum total weight
11 on any tandem axle shall not exceed 34,000 pounds, on
12 designated highways when appropriate regulatory signs giving
13 notice are erected upon the street or highway or portion of
14 any street or highway affected by the ordinance or
15 resolution.
16 The following are exceptions to the above formula:
17 (1) Two consecutive sets of tandem axles may carry
18 a total weight of 34,000 pounds each if the overall
19 distance between the first and last axles of the
20 consecutive sets of tandem axles is 36 feet or more.
21 (2) Vehicles for which a different limit is
22 established and posted in accordance with Section 15-316
23 of this Code.
24 (3) Vehicles for which the Department of
25 Transportation and local authorities issue overweight
26 permits under authority of Section 15-301 of this Code.
27 These vehicles are not subject to the bridge formula.
28 (4) Tow trucks subject to the conditions provided
29 in subsection (d) may not exceed 24,000 pounds on a
30 single rear axle or 44,000 pounds on a tandem rear axle.
31 (5) A tandem axle on a 3-axle truck registered as a
32 Special Hauling Vehicle, manufactured prior to or in the
33 model year of 2004, and registered in Illinois prior to
34 January 1, 2005, with a distance between 2 axles in a

1 series greater than 72 inches but not more than 96 inches
2 may not exceed a total weight of 36,000 pounds and
3 neither axle of the series may exceed 18,000 pounds.
4 (6) A truck not in combination, equipped with a
5 self compactor or an industrial roll-off hoist and
6 roll-off container, used exclusively for garbage or
7 refuse operations, may, when laden, transmit upon the
8 road surface, except when on part of the National System
9 of Interstate and Defense Highways, the following maximum
10 weights: 22,000 pounds on a single axle; 40,000 pounds on
11 a tandem axle; 36,000 pounds gross weight on a 2-axle
12 vehicle; 54,000 pounds gross weight on a 3-axle vehicle.
13 This vehicle is not subject to the bridge formula.
14 (7) Combinations of vehicles, registered as Special
15 Hauling Vehicles that include a semitrailer manufactured
16 prior to or in the model year of 2004, and registered in
17 Illinois prior to January 1, 2005, having 5 axles with a
18 distance of 42 feet or less between extreme axles, may
19 not exceed the following maximum weights: 18,000 pounds
20 on a single axle; 32,000 pounds on a tandem axle; and
21 72,000 pounds gross weight. This combination of vehicles
22 is not subject to the bridge formula. For all those
23 combinations of vehicles that include a semitrailer
24 manufactured after the effective date of this amendatory
25 Act of the 92nd General Assembly, the overall distance
26 between the first and last axles of the 2 sets of tandems
27 must be 18 feet 6 inches or more. Any combination of
28 vehicles that has had its cargo container replaced in its
29 entirety after December 31, 2004 may not exceed the
30 weights allowed by the bridge formula.
31 No vehicle or combination of vehicles equipped with other
32 than pneumatic tires may be operated, unladen or with load,
33 upon the highways of this State when the gross weight on the
34 road surface through any wheel exceeds 800 pounds per inch

1 width of tire tread or when the gross weight on the road
2 surface through any axle exceeds 16,000 pounds.
3 (f-1) A vehicle and load not exceeding 73,280 pounds is
4 allowed access as follows:
5 (1) From any State designated highway onto any
6 county, township, or municipal highway for a distance of
7 5 highway miles for the purpose of loading and unloading,
8 provided:
9 (A) The vehicle and load does not exceed 8
10 feet 6 inches in width and 65 feet overall length.
11 (B) There is no sign prohibiting that access.
12 (C) The route is not being used as a
13 thoroughfare between State designated highways.
14 (2) From any State designated highway onto any
15 county or township highway for a distance of 5 highway
16 miles, or any municipal highway for a distance of one
17 highway mile for the purpose of food, fuel, repairs, and
18 rest, provided:
19 (A) The vehicle and load does not exceed 8
20 feet 6 inches in width and 65 feet overall length.
21 (B) There is no sign prohibiting that access.
22 (C) The route is not being used as a
23 thoroughfare between State designated highways.
24 (f-2) A vehicle and load greater than 73,280 pounds in
25 weight but not exceeding 80,000 pounds is allowed access as
26 follows:
27 (1) From a Class I highway onto any street or
28 highway for a distance of one highway mile for the
29 purpose of loading, unloading, food, fuel, repairs, and
30 rest, provided there is no sign prohibiting that access.
31 (2) From a Class I, II, or III highway onto any
32 State highway or any local designated highway for a
33 distance of 5 highway miles for the purpose of loading,
34 unloading, food, fuel, repairs, and rest.

1 Section 5-35 of the Illinois Administrative Procedure Act
2 relating to procedures for rulemaking shall not apply to the
3 designation of highways under this subsection.
4 (g) No person shall operate a vehicle or combination of
5 vehicles over a bridge or other elevated structure
6 constituting part of a highway with a gross weight that is
7 greater than the maximum weight permitted by the Department,
8 when the structure is sign posted as provided in this
9 Section.
10 (h) The Department upon request from any local authority
11 shall, or upon its own initiative may, conduct an
12 investigation of any bridge or other elevated structure
13 constituting a part of a highway, and if it finds that the
14 structure cannot with safety to itself withstand the weight
15 of vehicles otherwise permissible under this Code the
16 Department shall determine and declare the maximum weight of
17 vehicles that the structures can withstand, and shall cause
18 or permit suitable signs stating maximum weight to be erected
19 and maintained before each end of the structure. No person
20 shall operate a vehicle or combination of vehicles over any
21 structure with a gross weight that is greater than the posted
22 maximum weight.
23 (i) Upon the trial of any person charged with a
24 violation of subsections (g) or (h) of this Section, proof of
25 the determination of the maximum allowable weight by the
26 Department and the existence of the signs, constitutes
27 conclusive evidence of the maximum weight that can be
28 maintained with safety to the bridge or structure.

1 (a) Local authorities and road district highway
2 commissioners with respect to highways under their
3 jurisdiction may by ordinance or resolution prohibit the
4 operation of vehicles upon any such highway or impose
5 restrictions as to the weight of vehicles to be operated upon
6 any such highway, for a total period of not to exceed 90 days
7 in any one calendar year, whenever any said highway by reason
8 of deterioration, rain, snow, or other climate conditions
9 will be seriously damaged or destroyed unless the use of
10 vehicles thereon is prohibited or the permissible weights
11 thereof reduced.
12 (b) The local authority or road district highway
13 commissioner enacting any such ordinance or resolution shall
14 erect or cause to be erected and maintained signs designating
15 the provision of the ordinance or resolution at each end of
16 that portion of any highway affected thereby, and the
17 ordinance or resolution shall not be effective unless and
18 until such signs are erected and maintained.
19 (c) Local authorities and road district highway
20 commissioners with respect to highways under their
21 jurisdiction may also, by ordinance or resolution, prohibit
22 the operation of trucks or other commercial vehicles, or may
23 impose limitations as the weight thereof, on designated
24 highways, which prohibitions and limitations shall be
25 designated by appropriate signs placed on such highways.
26 (c-1) (Blank).
27 (d) The Department shall likewise have authority as
28 hereinbefore granted to local authorities and road district
29 highway commissioners to determine by resolution and to
30 impose restrictions as to the weight of vehicles operated
31 upon any highway under the jurisdiction of said department,
32 and such restrictions shall be effective when signs giving
33 notice thereof are erected upon the highway or portion of any
34 highway affected by such resolution.

3 (e) When any vehicle is operated in violation of this
4 Section, the owner or driver of the vehicle shall be deemed
5 guilty of a violation and either the owner or the driver of
6 the vehicle may be prosecuted for the violation. Any person,
7 firm, or corporation convicted of violating this Section
8 shall be fined $50 for any weight exceeding the posted limit
9 up to the axle or gross weight limit allowed a vehicle as
10 provided for in subsections (a) or (b) of Section 15-111 and
11 $75 per every 500 pounds or fraction thereof for any weight
12 exceeding that which is provided for in subsections (a) or
13 (b) of Section 15-111.
14 (f) A municipality is authorized to enforce a county
15 weight limit ordinance applying to county highways within its
16 corporate limits and is entitled to the proceeds of any fines
17 collected from the enforcement.

19 Section 99. Effective date. This Act takes effect upon
