HOUSE RESOLUTION

WHEREAS, Section 2-3.25g of the School Code allows school districts to petition the State Board of Education for the waiver or modification of School Code mandates and State Board of Education rules; and

WHEREAS, Section 2-3.25g of the School Code requires the State Board of Education to file a report outlining the waivers requested by school districts and appeals by school districts of requests disapproved by the State Board of Eduction with the Senate and the House of Representatives and allows the General Assembly to disapprove the State Board of Education's report, in whole or in part, by adopting a resolution by a record vote of the majority of members elected in each house; and

WHEREAS, The process whereby the General Assembly considers and disapproves school mandate waivers and appeals needs to be more deliberative, informed, and cooperative; therefore, be it

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that there is created the Task Force on the Waiver of School Code Mandates consisting of (i) the chairperson and minority spokesperson of the House of Representatives' Elementary and Secondary Education Committee, who shall be co-chairpersons of the Task Force, (ii) the Deputy Governor for Education, and (iii) representatives of the Illinois Federation of Teachers, the Illinois Education Association, and the Illinois Statewide School Management Alliance, who shall be designated by the co-chairpersons of the Task Force, all of whom shall serve without compensation but shall be reimbursed for their reasonable and necessary expenses from funds appropriated for that purpose; and be it further

RESOLVED, That the Task Force shall meet at the call of the co-chairpersons, shall receive the assistance of legislative staff, shall study ways to make the process whereby the General Assembly considers and disapproves school mandate waivers and appeals more deliberative, informed, and cooperative, and shall report its findings and recommendations to the House by filing copies of its report with the Clerk of the House on or before January 1, 2005; and that upon filing its report the Task Force is dissolved.
