SYNOPSIS AS INTRODUCED:
 
820 ILCS 230/2.5 new

    Amends the Employee Washroom Act. Provides that, for temporary buildings or buildings under construction which are not yet occupied for their intended purpose: toileting and handwashing facilities shall be provided for the convenience of all workers; sanitary facilities shall meet specified requirements; separate facilities are not required for males and females if individual portable units are used; and for one through 200 employees, one facility shall be provided for every 40 employees, and for over 200 employees, one facility shall be added for every 50 employees. Provides that all non-sewered units shall be pumped regularly to assure adequate working facilities. Effective immediately.

1     AN ACT concerning employment.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Employee Washroom Act is amended by adding
5 Section 2.5 as follows:
 
6     (820 ILCS 230/2.5 new)
7     Sec. 2.5. Buildings under construction. An owner of a
8 temporary building or building under construction that is not
9 yet occupied for its intended purpose or the employer of
10 employees at such a building shall comply with the toileting
11 and handwashing facility requirements under Section 2. The
12 following requirements also apply to temporary buildings or
13 buildings under construction which are not yet occupied for
14 their intended purpose:
15     (1) Toileting facilities shall be enclosed and discharged
16 into a sanitary sewer. In lieu of connecting to a sewer, the
17 sanitary facility may be a portable, enclosed,
18 chemically-treated, tank-tight unit.
19     (2) If individual portable units are used, separate
20 toileting facilities are not required for males and females.
21 Toileting facilities shall be provided as follows: (A) for one
22 through 200 employees, one toilet facility shall be provided
23 for every 40 employees or fraction thereof; and (B) for over
24 200 employees, one toilet facility shall be added for every 50
25 employees or fraction thereof.
26     (3) All non-sewered units shall be pumped regularly to
27 ensure adequate working facilities.
 
28     Section 99. Effective date. This Act takes effect upon
29 becoming law.
