SYNOPSIS AS INTRODUCED:

625 ILCS 5/11-1010

from Ch. 95 1/2, par. 11-1010

Amends the Illinois Vehicle Code. Provides that a pedestrian who is under the influence of intoxicating compounds (as well as one who is under the influence of alcohol or drugs), to a degree which renders the person a hazard, may not walk or be upon a highway except on a sidewalk. Provides that a violation is a Class C misdemeanor (rather than a petty offense). Provides that a person who violates the provision is guilty of a Class A misdemeanor if the violation is a proximate cause of an accident resulting in great bodily harm or death to another person.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by changing Section 11-1010 as follows:

Sec. 11-1010. Pedestrians under influence of alcohol or drugs.

(a) A pedestrian who is under the influence of alcohol, other or any drug or drugs, intoxicating compound or compounds, or any combination thereof, to a degree which renders himself a hazard shall not walk or be upon a highway except on a sidewalk.

(b) Except as provided in subsection (c), a violation of this Section is a Class C misdemeanor.

(c) A person who, in violating this Section, is a proximate cause of an accident causing great bodily harm or death to another person, is guilty of a Class A misdemeanor.
