    Amends the Public Utilities Act. Makes a technical change in a Section concerning fire protection charges imposed by water utilities.

1     AN ACT in relation to utilities.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by changing
5 Section 9-223 as follows:
 
6     (220 ILCS 5/9-223)  (from Ch. 111 2/3, par. 9-223)
7     Sec. 9-223. Fire protection charge. The Commission may
8 authorize any public utility engaged in the production,
9 storage, transmission, sale, delivery or furnishing of water to
10 impose a fire protection charge, in addition to any rate
11 authorized by this Act, sufficient to cover a reasonable
12 portion of the cost of providing the capacity, facilities and
13 the water necessary to meet the fire protection needs of any
14 municipality or public fire protection district. Such fire
15 protection charge shall be in the form of a fixed amount per
16 bill and shall be shown separately on the utility bill of each
17 customer of the municipality or fire protection district. Any
18 filing by a public utility to impose such a fire protection
19 charge or to modify a charge shall be made pursuant to Section
20 9-201 of this Act. Any fire protection charge imposed shall
21 reflect the costs associated with providing fire protection
22 service for each municipality or fire protection district. No
23 such charge shall be imposed directly on any municipality or
24 fire protection district for a reasonable level of fire
25 protection services unless provided for in a separate agreement
26 between the municipality or the fire protection district and
27 the utility.
