SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-5.12b new

Amends the Illinois Public Aid Code. With respect to the Medicaid program, directs the Department of Public Aid to establish a Prescription Drug Therapeutics Committee to review and either approve or reject the Department's prescription drug policies and management practices.

AN ACT concerning pubic aid.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 5-5.12b as follows:

(305 ILCS 5/5-5.12b new)

Sec. 5-5.12b. Prescription Drug Therapeutics Committee.

(a) The Department of Public Aid shall establish a Prescription Drug Therapeutics Committee ("the Committee") to review and either approve or reject the Department's prescription drug policies and management practices.

(b) The Committee shall be composed of the following 11 members:

(1) Five physicians licensed to practice medicine in all of its branches in Illinois, including the following:

(A) one physician with expertise in the area of family practice;

(B) one physician with expertise in the area of pediatrics;

(C) one physician with expertise in the area of geriatrics;

(D) one physician with expertise in the area of psychiatric medicine; and

(E) one physician with expertise in the area of internal medicine and who specializes in the treatment of diabetes.

At least 3 of the physicians must have at least 3 years of recent experience in prescription drug formulary management, including therapeutic category review.

(2) Two pharmacists who are licensed to practice pharmacy in the State of Illinois and who have a doctor of pharmacy degree or equivalent degree.

(3) Two representatives of medical assistance recipients who advocate on behalf of recipients for improved services.

(4) Two medical assistance recipients who have had experience with prescription drug policies of the Illinois Department of Public Aid.

Committee members shall be appointed for terms of 3 years. A member may be reappointed to the Committee upon completion of the member's term.

The Committee members shall select a chair of the Committee from among the members.

(c) A member of the Committee may not be employed by or contract with the State of Illinois, a pharmaceutical manufacturer or labeler, or a pharmacy benefits management organization. A member of the Committee may, however, contract with the State under a medical assistance provider agreement for the sole purpose of delivering services to medical assistance recipients.

(d) The Committee shall meet at least quarterly and shall also meet on the call of the chair of the Committee. A quorum of the committee consists of 7 members. The affirmative votes of a majority of a quorum of the Committee are required for the Committee to take action on any measure.

(e) The Department of Public Aid shall reimburse Committee members for their reasonable expenses actually incurred in performing their duties and shall provide staff support to the Committee at the request of the Committee chair.

(f) A meeting of the Committee is a meeting of a public body for purposes of the Open Meetings Act.

(g) The Department of Public Aid shall adopt rules to implement this Section.
