    Amends the Private Sewage Disposal Licensing Act. Makes technical changes in Sections concerning the short title, the purpose of the Act, and the definitions.

1     AN ACT concerning professional regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Private Sewage Disposal Licensing Act is
5 amended by changing Sections 1, 2, and 3 as follows:

7     Sec. 1. Short title. This Act shall be known and may be
8 cited as the "Private Sewage Disposal Licensing Act".

11     Sec. 2. Purpose of Act. It is hereby declared that there
12 exists, and may in the future exist, within the State of
13 Illinois, private sewage disposal systems which are designed,
14 constructed, operated, maintained or serviced or which may be
15 designed, constructed, operated, maintained, or serviced in
16 such a manner as to cause spread of infectious or contagious
17 disease and such conditions adversely affect the public health,
18 safety and general welfare of persons. Therefore, the purpose
19 of this Act is to protect, promote and preserve the public
20 health, safety and general welfare by providing for the
21 licensing of private sewage disposal contractors and the
22 establishment and enforcement of a minimum code of standards
23 for design, construction, materials, operation and maintenance
24 of private sewage disposal systems, for the transportation and
25 disposal of wastes therefrom, and for private sewage disposal
26 servicing equipment.

29     Sec. 3. Definitions. As used in this Act, unless the
30 context otherwise requires:

1     (1) "Domestic Sewage" means waste water derived
2 principally from dwellings, business or office buildings,
3 institutions, food service establishments, and similar
4 facilities.
5     (2) "Director" means Director of the Illinois Department of
6 Public Health.
7     (3) "Department" means the Illinois Department of Public
8 Health.
9     (4) "Human Wastes" means undigested food and by-products of
10 metabolism which are passed out of the human body.
11     (5) "Person" means any individual, group of individuals,
12 association, trust, partnership, corporation, person doing
13 business under an assumed name, the State of Illinois or any
14 Department thereof, or any other entity.
15     (6) "Population Equivalent" means an average waste loading
16 equivalent to that produced by one person which is defined as
17 100 gallons per day.
18     (7) "Private Sewage Disposal System" means any sewage
19 handling or treatment facility receiving domestic sewage from
20 less than 15 people or population equivalent and having a
21 ground surface discharge or any sewage handling or treatment
22 facility receiving domestic sewage and having no ground surface
23 discharge.
24     (8) "Private Sewage Disposal System Installation
25 Contractor" means any person constructing, installing,
26 repairing, modifying, or maintaining private sewage disposal
27 systems.
28     (9) "Property Owner" means the person in whose name legal
29 title to the real estate is recorded.
30     (10) "Waste" means either human waste or domestic sewage or
31 both.
32     (11) "Private Sewage Disposal System Pumping Contractor"
33 means any person who cleans or pumps waste from a private
34 sewage disposal system or hauls or disposes of wastes removed
35 therefrom.
