SYNOPSIS AS INTRODUCED:
 
110 ILCS 805/2-12.2 new

    Amends the Public Community College Act to require the Illinois Community College Board to establish a new community college district to be comprised of the territory of the former Metropolitan Community College District No. 541 and to be known as Gateway Community College. Provides that the Board may not abolish, restrict, or take over the operation of Gateway Community College without first notifying the General Assembly and receiving permission from the General Assembly for the action. Requires the Board (i) to provide financial and technical assistance to Gateway Community College in becoming established, (ii) to transfer to Gateway Community College all documents, equipment, and books and any other personal property that was in the possession of or owned by the former Metropolitan Community College District No. 541 at the time that it was abolished, and (iii) to convey to Gateway Community College the real estate and improvements that comprised the campus of former Metropolitan Community College District No. 541 at the time that it was abolished.

1     AN ACT regarding higher education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Community College Act is amended by
5 adding Section 2-12.2 as follows:
 
6     (110 ILCS 805/2-12.2 new)
7     Sec. 2-12.2. New district; former Metropolitan Community
8 College District No. 541.
9     (a) The State Board shall establish a new community college
10 district, to be known as Gateway Community College, to be
11 comprised of the territory of former Metropolitan Community
12 College District No. 541 established under Section 2-12.1. The
13 State Board may not abolish, restrict, or take over the
14 operation of Gateway Community College without first notifying
15 the General Assembly and receiving permission from the General
16 Assembly for the action.
17     (b) The State Board shall provide financial and technical
18 assistance to Gateway Community College in becoming
19 established. The State Board shall transfer to Gateway
20 Community College all documents, equipment, and books and any
21 other personal property that was in the possession of or owned
22 by former Metropolitan Community College District No. 541 at
23 the time that it was abolished. If the State Board fails to
24 transfer the documents, equipment, books, or any other personal
25 property to Gateway Community College, the State Board shall
26 make a full accounting of the items not placed in the physical
27 and legal custody of Gateway Community College to the governing
28 board of Gateway Community College, with an estimate of the
29 replacement cost of the items, and shall credit the accounts of
30 Gateway Community College in that amount. The State Board
31 shall, upon the date of the establishment of Gateway Community
32 College, convey to Gateway Community College the real estate

1 and improvements that comprised the campus of former
2 Metropolitan Community College District No. 541 at the time
3 that it was abolished.
4     (c) The State Board shall adopt all rules necessary to
5 carry out its responsibilities under this Section.
